Missing court case

hi I moved to Spain after finding out I had court case. I had already planned to go to Spain way before this came along. I went to the first date, it got postponed, and I didn’t want to spend the money going again 2 months later, when I know it’s going to be postponed. In my area all court dates get postponed to atleast a year after your charged. What will happen to me know when I go back to Ireland? Or if I travel anywhere outside of Spain am I going to be arrested ?

The charges where theft in a workplace, before anyone judges, my father had just passed and my step mom was trying to look after 4 kids with no help from the government. So steal from the rich. It is 12 charges amounting to 4 grand

Legal advice cannot be offered here. You should find a solicitor local to the court and engage their services.

If you are not there, a bench warrant will be issued and you will be liable to be arrested when you next appear in the jurisdiction. If that happens, you may have difficulty getting bail whilst awaiting trial.

And if you don't return to the jurisdiction Gardaí may apply for a European Arrest Warrant (EAW). If this is issued this means if you are stopped by Police or arrested in any EU country you will be detained and an application will be made to extradite you to Ireland to face trial.

It is unlikely the guards would go to that trouble over a 4k theft.

Unlikely but possible. In my experience EAW are being utilised a lot more now Ireland is part of the Schengen Agreement

Sorry not Schengen itself but AGS have access to Schengen Information System (SIS) since 2021

The o/p is hiding his head in the sand. The first question which will be asked when the case is heard is whether the money has been paid back. If the money was paid back and there was an early guilty plea and co-operation with the guards the sentence will be towards the lighter end. If the money is not paid back and there are missed court dates and bench warrants, it will not go well. The District Court might refuse jurisdiction altogether which would be very serious for the o/p.
