    I disagree with you accusing people of being ignorant over home schooling though. The fact that other countries had to outlaw it speaks volumes.

    Just start sequestering the fk'ing assets. It's the only way to force this absolute lunatic to end his ridiculous crusade.

    I imagine every penny he's got so far has been moved away - 'gifted' to parents and siblings within tax allowances - so all there will be to get will be the last few weeks of his salary before his appeal is finally rejected.

    The state and CAB can seize assets from armed criminals and dangerous gangs but it seems can't do the same when it comes to one religious fanatic. Different laws broken I know but it's very frustrating.

    I hope he did try that because moving or attempting to conceal assets that are subject to being seized is a crime and is something he could be charged with.

    once he is officially fired, this charade he is playing will finally be over.

    He believes he still has a workplace now because he is still on the payroll. This is the only reason he is turning up at the school.


    get the appeal done and dusted and take his “job” away from him once and for all that and he will stop turning up.

    You do realise those kids weren't isolated in the way the Burkes were. Those kids are experiencing social difficulties with other kids. They feel isolated. they aren't being kept away from other children. It's entirely different.

    Also, you'll note that in the very links you provided being isolated from other kids is bad. It's not a good thing. Kids feeling isolated or being isolated is bad.

    And you'll notice that I said that people who deliberately isolate their children are at best suspect and at worse abusive. I didn't say home school kids are abused, I said kids who are isolated.

    And I'll stick by that. Anyone who deliberately keeps their kids away from all other kids is at best suspect and at worst abusive.

    And the Burkes are evidence of that. raised in a cult like environment. Complete obedience to the cult leader. No ability to live normal lives. They're socially and emotionally stunted.

    That shouldn't be allowed.

    Edit: just saw the mod post saying to avoid this topic. I spent ages writing so I won't delete, but I won't mention it again and I won't expect a reply.

    Unfortunately no it won't. There is years left to run on this.

    The hope is that if enters the school grounds again after the Dept. of Education stop paying him he will be criminally charged. That sends it down a more manageable route for the school at least. Of course he could park up outside the school grounds on a public road. But Bail conditions can stipulate he goes no where near the school if they criminalise him.

    But he will definitely be off to the WRC - Labour Court and maybe High Court.

    Also listening to the AG rep yesterday, the best he could come up with when asked was there a mechanism to recoup the fines, was we think so. So there will be definitely a temporary injection sought against that too. The last "temporary" injunction Burke got lasted about a year and a half.

    So unless Daddy Burke has a moment of clarity after being released from the joy and reigns his wife in, there is a bit left to go yet.

    Judge Nolan said a garnishee order had never been used in such a way here, but he did not believe there was any reason in principle why it could not be done. He said it was ‘bizarre’ that the courts had the power to ‘lock someone up and fine them’, but because there was no statutory regime for contempt of court, there was no set procedure as to how the fines could be recovered.

    You'd think he would have realised that before imposing the fines.

    What a fúcking cluiche saighdiúirí this is turning out to be.

    I did wonder if the sheriff (receiver of fines) could be used to collect the fines. It seems there are sheriffs in several counties.

    The role of the Sheriff (Receiver of Fines) was established to enhance the collection of fines imposed by the courts. Under the Fines (Payment and Recovery) Act, 2014, the Receiver of Fines has the authority to seize real property to recover unpaid fines.

    Same question though, what real property does he have?

    The idea of seizing property is to sell it.

    I imagine his satchel could command a few 100 at a novelty auction, but that would about it.

    Even if he had a car worth 40k (which he doesn't) still wouldn't scratch the surface.

    It's pretty clear now. The younger children at least are being used as serial agitators by their mother.

    This happened in College and has now happening once they entered the work force.

    The notoriety is what to crave, whether that is because it is a vehicle for outside finance or the mother has untethered herself so much from reality that a return to land is impossible and sacrificing anything resembling a fruitful life for her children is the price they have to pay. Or both.

    Again, it's extremely hard to second guess horrible cretins and what they might do, but a pattern has developed.

    One should hope the Appeal Panel will rubber stamp the dismissal, if they have agreed to hear the case and take testimony, could be another month depending on timing.

    The assumption is though either way they will agree with the decision of the BOM.

    Burke then has 6 months as standard to file with the WRC, once the WRC accept it and appoint an Officer, Burke will then find some BS to get the case delayed with a temporary injunction.

    Rational doesn't come into it, it's all about agitating and drawing it out.

    It's a small point, but rubber stamping of decisions is exactly what causes employers to end up in the WRC or Court. The Appeals Tribunal will needs to do the exact opposite of rubber stamping.

    The Appeals Panel are entitled not to hear the case if certain conditions are met or not met and revert back to the decision of the BOM.

    But if are you are seriously suggesting whether they meet or not will determine whether Burke opens a case with the WRC I suggest you haven't been paying attention.

    Just to point once more, Burke initiated proceedings to get an Appeals Hearing and then got a "temporary" injunction lasting well over a year against it.

    I'm suggesting that rubber stamping isn't a good idea.

    It's not about whether he decides to open a WRC case. It's about whether he is able to show that the employer didn't take the appeal process seriously.

    Well no.

    It's up to Burke who has delayed this for well over a year to furnish the board with actual reasons why the review is being sought.

    The School then get to a right of reply.

    If those reasons are not relevant to the termination, then the Appeals Panel do not have go forward.

    If as you suggest it hinges on taking the appeal process seriously, well then that is literally everyone but the Burkes.

    My point has nothing to do with Burke’s tactics. My point is that any decision making body that takes a rubber stamping approach to their decision making runs a serious risk of it blowing up in their face at a later stage.

    You have to wonder if Mountjoy is a bit of a holiday camp the fact that EB and some members of his family arent deterred to be locked up in there again, and again.

    If we had risons pen par with a first world prison like Singapore for example, from a documentary I watched, I'm telling you, once you leave a Singapore prison, you never ever want to go back.

    Rubber Stamping was the phrase I used. Like I explained earlier.

    An Appeal Panel are entitled as part of the process not to go to hearing and revert back to the BOM.

    It is a perfectly legitimate part of the defined process.

    And as I see it in this case the criteria has been well met not go to hearing.

    That is not to say they won't, or haven't decided to already. We just haven't heard about it.

    Either way the school have pretty much a free swing at the WRC in reality. He has continued to receive his salary for over 2 years and the Supreme Court ruled recently that schools are different to commercial enterprises and that the WRC should reserve judgements of reinstatement to the most exceptional of circumstances.

    Not much the WRC can actually award him if by some miracle he followed the process and actually got a positive outcome.
