Enoch will be 80+ and still paying off his fines in 2070

Whatever he is doing with his assets/money should not be our concern.

The state and our laws should do what they need to to to ensure our laws/fines are being upheld; if he is using underhand methods to try avoid paying fines, then the state/bodies need to go after the money and assets. Follow the trail: If it means freezing other accounts, so be it……this family are making a mockery of our legal system….

Not an expert on the law, but I would hope our legal system is using every power available to retrieve these fines, or part of them

If he is giving the wages to someone else in the family there will, I presume, be a tax liability for the recipient??

  • Registered Users, Registered Users 2 Posts: 31,908 ✭✭✭✭AndrewJRenko

Same for every parent getting a contribution to the family budget from their adult child?

Same for every sibling getting a contribution to vehicle running costs from their sibling?

    #MEGA MAKE EUROPE GREAT AGAIN

Gifts you receive up to the value of €3,000 from any person in a calendar year are exempt from Capital Acquisitions Tax (CAT). This means that you may take a gift from several people:

    • in the same calendar year
    • and
    • the first €3,000 from each disponer is exempt from CAT.

Gifts of €3,000, as outlined above, are not taken into account in computing tax and are not included for aggregation purposes.

This small gift exemption applies only to gifts and not to inheritances.

    https://www.revenue.ie/en/gains-gifts-and-inheritance/cat-exemptions/small-gift-exemption/index.aspx

Essentially he could hand over his monthly salary to a different sibling/parent every month and they would have no tax liability - rinse and repeat the following year

it doesn’t make any sense or it’s not necessary to hand over his salary. If there’s money in a bank account with his name that money can’t be touched at the moment. If he had cash or other physical assets that’s another matter.

It would be ludicrous to imagine he’s sending his wages to siblings accounts each month. To do so in the first place would mean admitting he’s in the wrong.

That in itself tells a story. I reckon the school would be better off doing nothing for about 2 week. Let him off, the interest in him will wane, then have him 'lifted' and back to The 'Joy.

At the pace his dismissal process is going, he'll be due retirement before it is done. He'll probably launch more legal proceedings then to be declared a 'teacher emeritus' or some other BS at Wilsons.

Nice to see more than just Daddy Burke can drive, I suppose.

In all seriousness though, this is ridiculously drawn out at this stage, what a waste of time and money by everyone.

Someone further up the thread mentioned the courts may set a new legal precedent to deal with the Burkes. That's the last thing the courts will do. If they break with precedent, it will open up a whole new and possibly valid avenue of appeals for them. The last thing they want is give them a win.

"I would hope our legal system is using every power available to retrieve these fines, or part of them"

I havent read anywhere how the justice system is going after the due fines. But funny, when I refused to pay a parking fine a couple of years ago as I was appealing it, I got a letter telling me my fine had doubled as the 28 day due date had passed and I was going to get a court summons within a week if I did not pay end, and the letter reminded me that if I was found guilty of not paying the fine, I would have a criminal conviction. Yes, for a flippin parking fine. I paid it to avoid all that sh*te. That was a pissy fine of less than €100. E.Burke's fine is up to what now ? Well over €10,000 at this stage right ? Where's the fairness here? Why isnt this being chased up ?

Add a zero and double it… "The teacher owes over €193,000 in fines for continually being in contempt of court by showing up to the school."

TBF the potential for Enoch and his antics were flagged decades ago.

Our contempt laws are long past due being put on a statutory footing.

This could actually get it done.

When he was working there, how was he travelling to work and back?

  • Registered Users, Registered Users 2 Posts: 72,889 ✭✭✭✭L1011

He was renting nearby and saving for a deposit to buy, according to one of his own media interviews early on (when he had some more support than he does now)

I'd say he was great craic as a house mate 🙄

I have an image of him as a lodger with a vicar's widow or something rather than in a more normal house share (or renting solo, which doesn't leave savings headroom)

Or possibly staff quarters as part of the boarding side of WHS.

  • Registered Users, Registered Users 2 Posts: 5,529 ✭✭✭keeponhurling

is WHS a public or private (fee-paying) school ?

I’m wondering who ultimately pays Enoch’s salary, is it the taxpayer or the parents who pay fees

The school need to advertise his presence to tourists and charge admission to see him.Could be a real money spinner for them.

  • Registered Users, Registered Users 2 Posts: 5,529 ✭✭✭keeponhurling

could they offer a livestream ?

I remember people watching David Blaine in a box over London

Public, was private but changed some time ago.

Boarding costs money but day pupils are free.

Private schools get significant part payment of teachers salaries anyway.

I do wonder if this was a Catholic School owned and ran by the Diocese would this lawlessness have been tolerated?

Something tells me the soft gloves would have been off.
