Notifying respondent of in advance of lodging complaint WRC?

    This seems new to me. As I remember it, all you had to do before taking a case, was to be able to show that you made an effort to resolve the issue with your company yourself first.

    "Please be advised that several of the Acts dealt with by the WRC require prospective complainants to notify the respondent in advance of lodging the complaint form. For example, the Equal Status Act4 (the “ESA”) requires a complainant to notify the service provider in advance of making the complaint. Moreover, the National Minimum Wage Act requires the employee to request a statement of earnings from the employer prior to referring a dispute. Complainants should complete these preliminary steps and submit the information as part of the complaint".

    I didn't think that you had to actually contact your company saying that you were taking a case against them! I certainly didn't do that the last time I brought a case to the WRC and I heard nothing about it.

    Any advice?

    As it says, the various laws that the WRC is responsible for enforcing have different requirements about what steps (if any) need to be done before referring a dispute to the WRC. You'd want to check the legislation that is relevant to your complaint before submitting it to see if there are any preliminary steps you'd need to follow. Some of the laws like the Unfair Dismissals Acts and most sections of the Organisation of Working Time Act don't have such a requirement, though.
