Paying duty on free replacement for broken part?

Just checking this is right.

I purchased an item from Australia and paid duty on it when it arrived.

A section cracked so I was sent a free replacement but An Post are charging me duty on that.

Is that right? When i get items from DHL I just show them the previous purchase and duty paid and they remove duty on free replacement parts.

I called An Post but they declined my request.

As far as I'm aware the sender needed to make a customs declaration that it was a replacement part. I don't think An Post/DHL can alter what's on the declaration at this point.

A customs invoice should accompany any items, even if it's zero value.

correct.

The invoice should clearly state it is a replacement part for a damaged in transit item and zero value for customs purposes.

Just saying its "free" doesn't wash as that would be open to huge abuse.

Provided the sender gave the correct details on the customs declaration. You can't just tell customs that now.

With a customs invoice you pay duty based on the value : on a zero value invoice the charge should be zero, though beware, if you had to pay any shipping then that would be part of the overall value.

It needs to state clearly on the invoice the reason why it is zero.

When i spoke to An Post they said that if the value was 0 then they would send it back, so it must be a requirement to include some sort of value on it.

From what I understand it says replacement on it but also has a value, which is what duty is being charged on.

Unfortunately with An Post I'm not allowed to see the description until it's in my hands whereas with DHL there's usually a copy I can receive.
