Refused Part Time work with 2 kids

Hi I’m looking for some info, I am currently on Maternity and due to return In July I have requested to cut from 5-4 days work. They have refused this and want me to return on a 5 day basis I cannot afford this with childminding monies! Can I use the letter I have from them in writing stating they are refusing my request to sign on jobseekers and search for another job

How would the letter benefit you? Does it say there is no work or reduced hours or job loss?

One of the conditions for signing on is that you are declaring that you are available for full time work. The letter might go against you if you're ruling yourself out of full time jobs

If your contract is for a full-time role then the employer is under no obligation to offer you a shorter/part-time

Try putting in a request for Parental Leave, one day a week. You have a statutory entitlement to parental leave, though how the give it is at the employer's discretion. They can only delay this, not outright refuse it, so they have to consider it.

A letter for DSP will not help you, as if you're not available for (and seeking) full time work, you're not eligible for a jobseekers payment.

Also, telling DSP the reason for quitting your job is because you cant work full time due to childcaring responsibilities would also disqualify you.

Have you checked out all your eligibility for childcare subsidies?

You also have until July to seek alternative part-time employment.

I was going to suggest the same. I also think they can only delay it twice, you'd need to check the guidelines. Do pay attention to the guidelines as some employers are not great with following them.

Childcare is expensive but remember ecce will kick in , in a couple of years.

Could you apply for family income support? Might help get you over a hurdle.

Separate from maternity leave and return, there is an obligation for employers to consider requests for part time work. But not a requirement to grant it.

OP the letter is irrelevant at this stage: just look for another job that suits you better.

An employer can refuse a request for parental leave if it is in the form of days or hours.

Yes, days or hours is with their agreement. A single block or 2 separate blocks of at least 6 weeks is a statutory entitlement and then can only delay that, not refuse it. They can delay it twice if thats due to seasonal demand issues.

If you're considering quitting to go on job seekers, would you not consider quitting and looking for a part-time role elsewhere?

As others have mentioned, applying for parental leave is an option.

If your employer knows you are serious about not being able to return full-time they might be able to work around to help you. It happened me. I told them I couldn't work full-time from a specific date (4 months away). They said they'd need me to work full-time. I told them it wasn't possible. I approached ot multiple times over the 4 months. Always told the same thing. I handed in my notice coming up to the date where I couldn't work full-time anymore. They refused to accept my notice and asked me what hours I could do.

If you're going to hand in your notice, try have something else lined up. There is part-time work out there.
