Paddy Power misrepresentation of winnings

Won a small bet last week.

€50 3/1

Paddy Power "congratulated" me on winning €200.

But I did not win €200, I won €150 and also got my stake back.

I don't bet often. This was from a tip and decided to give it a whirl. The "congrats" message just caught my eye and frankly thought it was blatant misrepresentation and false.

Would probably give some people a false feeling of being more "successful" at betting than they are.

I get what you’re saying but the moment you placed that €50 it was no longer yours, it was then paddypowers money so you did in fact win €200 albeit a profit of €150.

I never said it was a problem. Just an observation on what seems to be misrepresentation and give some people a false feeling of higher winnings - feeds into the issue of problem gambling and benefits paddy Power

It's a contract, just like many other simple contracts.

If the race was abandoned half way through, a refund would be obligated as the contract was for the result of the full race.

But by asking for money back halfway just because your horse is losing is breaking the contract. But that contract is not fulfilled until the result is declared.

If your horse didn’t win, your €50 was gone, by winning you won your €50 back, plus the amount linked to the odds.

Incidentally, no contract exists when playing a bet, debts are unenforceable.

A bet with a bookmaker is not a contract, it's a gentleman's agreement. A contract needs a signature from both sides.

This is evident when a bookmaker sometimes refuses to pay out on an anti-post bet, because there is no signature meaning the punter hasn't a leg to stand on.

That’s true. But none of those apply to placing a bet with a bookie.

The bookie has no legal obligation to pay out on any winning bet.

There is a contract formed. However it is not a legally enforceable contract and the law of reasonableness comes into play.

Just as there is no absolute legal obligation for a retail store to give to change from €50 when the goods are €10, however it is reasonable to expect change.

In both cases a law is not required as a retail business and a bookie business would be out of business overnight if they did not give change / pay out on winning bets.

When you pull a slot with 1 euro and win 0.50... the 0.50 is still winnings, despite being a loss.
