In addition, all of his defenders moan about the fact that it is unprecedented.

Do you know what else was unprecedented?

The behaviour of a (former) president that brought about these charges. That's never mentioned though.

It's like trump was always as pure as snow and out of the blue, these nasty people decided to harass him.

I guess we now know that if he did shoot someone on fifth avenue, good defence would be that charging him was "political".

Unfortunately the majority of them folk don't have a history book and seem to forget about ex vice president Spiro Agnew who was charged with felonies

Actually, that's how he declassified files. He puts his hand on the files and declassified them with his mind powers. "If you're the president of the United states you can declassify just by saying 'its declassified' even by thinking about it". (DIRECT QUOTE).

So he was probably laying on of (small) hands and using his presidential mind powers to declassify...... that may ACTUALLY by his defence

This was covered at the time.

Whether the docs were classified or not isn't the only issue.

Maybe - I don't think there is a reference to prison in the Former Presidents Act (1958) references incarceration.

    Newsweek speculates they will:

Former agency officials have speculated that it's likely Secret Service agents would go with Trump to protect him in prison.

One unnamed former official told Business Insider that while there wouldn't be protective detail inside a cell with Trump, it's likely there would be at least one agent on the property.

However, ChatGBT does not think so:

No, if an ex-US president goes to jail, they do not keep their Secret Service detail. Secret Service protection is provided to a former president for the rest of their life, unless they waive the protection. However, if a former president is convicted and sentenced to serve time in jail, they will lose their Secret Service detail during their time in prison.

According to the Former Presidents Act, which was passed in 1958, former presidents are entitled to a range of benefits, including a pension, an office, and Secret Service protection. However, the law does not specify that Secret Service protection must be provided to a former president while in prison, so it would not be available during that time.

It's worth noting that no former US president has ever been sent to jail, although several have faced legal proceedings and impeachment.

I presume there will be one on shower duty. 😁

I doubt he’ll ever go to an actual prison no matter what/if he’s found guilty of. It’s a fairly strange set of circumstances and I imagine that some sort of in house incarceration would be organised

  • Registered Users, Registered Users 2 Posts: 6,781 ✭✭✭Flaneur OBrien

Hard agree. No chance he'll ever be sent to prison. House arrest, no access to internet, or limited to some news sites and no media interviews would be about the best one could hope for.

It'll be the lack of golf that kills him 🤣

Years before this resolves. Found guilty, appeal, appeal, appeal. The various side cases that likely arise due to bad behavior by his defense counsel? Appeal, appeal... Every delaying tactic in the book, including ones we haven't seen, will be brought to bear.

And when it does, apparently it's a max 4 year sentence, it'll be brief, house arrest, some limited restrictions on his behaviors.

The absolute worst aspect of this is this clown front page news for the next few years. So depressing. Even if he drops from the race or doesn't get the nomination, he'll still be in the news.

It's federal crimes he's supposedly charged with, why do you think he'll only get house arrest?

The best outcome from a Federal case would be barring him from public office. Which, if the GOP ever get their collective acts together is exacty what they should hope for so they can safely move on from Donnie while holding onto a chunk of the MAGA crowd.

He is being charged by the manhattan DA not SDNY.

  • Registered Users, Registered Users 2, Paid Member Posts: 36,607 ✭✭✭✭Penn

Extreme extenuating circumstances and the likelihood that imposing specific restrictions on him as part of house arrest would ensure he can't commit further similar offences.

Not saying he shouldn't get jail time, but it's highly unlikely given his age, he's a former President, and they were non-violent crimes.

If the charges are relating to falsification of business records in trump. Org , Weisselnberg served time for those crimes.

If the charges are the campaign finance violations, Cohen served time for those crimes

He actually thought no one would prosecute him. He'll be flying from one courtroom to another in a few months.

  • Registered Users, Registered Users 2, Paid Member Posts: 5,157 ✭✭✭Rawr

Part of me wouldn't mind him in the news for the reason of how much of a train-wreck he is. I can't imagine him behaving himself at all, and while some might see that as him electioneering in the hope that all this will go away upon re-election, I feel that this will just serve as a regular reminder to moderate voters that the drama he'll being to the courtroom would also be returned to the White House.

He is no longer the Trump of Apprentice fame, who might have been a billionare property kingpin in New York. He's the obnoxious wind-bag who embarressed an entire nation for 4 years straight, had a revolving door of roles in his White House (staffed also by his kids), and has enabled a ferel cult following who pepper anything that Trump says with an extra layer of stupid.

The next few years of court appearances will serve to remind everyone what we all know. Donald Trump is an abysmal excuse for an adult who can't be counted to run a laudramat let alone any large company or nation. I hope these cases bleed him of what little cash he really has. That would be a better punishment than prison I feel. No chance to be a martyr, just poverty until the end.

"There goes poor old Donald Trump. Did you know he used to run a fancy Manhattan property firm? Then he became preseident. He kept going to court and lost all his cash to legal fees. He tried to get more cash from Russians...but sure enough they hadn't any left either because of the War. His trophy wife left as soon as she found out that her inheritence from him didn't really exist and most of his kids swapped "Trump" from their names by deed-poll. They didn't visit after they had to put him into this Medic-aid funded Senior Center. Now he spends his days...just staring at Fox News..hoping that they'll mention his name again..."

Bragg would be an officer of the court IWT, as of today. Mouthing off could find Trump in contempt of court.

Oh no. He'll never step foot in a cell. We know that. We've been saying that since the start. Even if he's found guilty later of much more serious charges like election tampering and attempted insurrection, he would still not step foot in a cell. As mentioned, house arrest (Complete with ankle monitor) for 2 years, ban on media/social media and ban on writing books/profiting from his actions for a period of 10 years or something would be most likely.

And that would please his cult too: "See? we (We!!!) beat ya. He got away with it. No prison. Hah. Screw you, libs".

I do believe that his chances of winning election are going to be pretty minimal now though. Now that doesn't mean he won't run again. Or try to steal the election AGAIN. Or tell his hate groups "We love you. Stand down and stand by" AGAIN. But I do think it's over for him. And the sooner the GOP rid themselves of him and his GQP crew the better.

We've all said that the GOP should have taken the opportunity in the week after Jan 6 insurrection attempt to throw trump and his croneys under the bus. They would have had a nice clean run of it since then to now to distance themselves from him. And even root out more of his cult like MGT as more revelations emerge, They could have pointed back at him and his cult and said "Look, we really DID empty the swamp.... of trump and his people who tarnished the good name of the GOP". Yadda yadda yadda. They could have dug up all the dirt they have to bury him and move on to DeSantis (Who is just as offensive but with more polish. So even worse). They would have had time to big DeSantis up as the "better" trump. A trump that actually cares for 'Murica. They would have had a rough year or so but every time more dirt comes up about trump, the BETTER it would be for them as they could say "Phew, we got rid of that guy. He wasn't the GOP. He's more DEM than GOP. Those are DEM morals!!!". And every time they compared his loose morals to the libtards, they would push the MAGA cult closer to DeSantis. By now they would be ALL OVER DeSamtis and trump would have been a Dem collaborator or something. I stated previously that I thought if they got rid of trump that they would definitely lose 2024 election but would take that hit 'cos 2024 world is still going to be in the toilet. But I now think that, had they gotten rid of trump in the week after Jan 6 insurrection attempt, they would actually win 2024 easily.

On Jan 7 they wobbled.... And then tucked their tails between their legs and folded and embraced the GQP. The old school GOP members who folded, what do they think of themselves at 4AM. When they look in the mirror. When they hear another ignorant, ill-informed, unprofessional (Usually already-disproved) lie from MGT or trump or his cult? The career GOP members with 30, 40 + years of service. The ones who wobbled on Jan 7 and then folded after half their life representing their party. If they hadn't already sold their soul to the GQP, it would be soul destroying.

Wouldn't be at all surprised to see a gag order imposed, due to Trump's constant nonsense whinging. That would be lovely to watch, there's no way Trump can ever keep his mouth shut so he could end up in contempt.

Legal fees only cost you money if you pay them. Trump is famous for not paying. Why do you think he keeps changing attorneys?

  • Registered Users, Registered Users 2, Paid Member Posts: 6,702 ✭✭✭TheIrishGrover

Even without a gag-order I would imagine he could be held in contempt for his posts. All hyperbole aside, being as impartial as possible, I assume that there are VERY strict rules and regulations about ongoing cases and what can be publicly released. And what can be said by and about people involved with the case.

I think there was some issue lately with some court official stating somewhere that they thought trump was guilty. I can't remember the details. But yeah, I can imagine that all parties involved in the trial(s) will have to follow extremely strict guidelines regarding media/social media. I know trump has stated that the judge hates him. But I wonder what would happen if he says that when the trial starts?

I think your point @PropJoe10 is a VERY valid one. What will happen if he starts commenting on the ongoing case on media//social media. Or either party (But let's be honest, if anyone is going to comment, it will be him). It will be a nightmare for his lawyers.

Byron Donald hitting the Nancy Pelosi tweet on CNN just now.

Twisting talking points and spouting shite with very little challenge on the facts from Kaitlan Collins.

Did consider that. My guessing is that any lawyer who isn't of Rudy-quality will have somehow tried to get some payment guarentee given Trump's track record. Possibly even pre-payment. He didn't even pay Rudy, and look at the state of him now.

I feel that either Trump's got the thickest idiots to ever pass the Bar exams or he's prepaid someone who is half-decent.
