BER and Contract

    If a BER assessor doesn't attend to inspect/assess a new build home, and the home is subsequently signed off with a final BER certificate and the keys handed over to the buyer, is the builder in breach of their contract with the buyer?

    A BER assessor has to do a detailed measured and photographic survey of the finished house and get signed drawings and specification from the engineer along with a host of other information pertaining to the heating, ventilation and windows. This is the process all assessors are required to go by so if you think the house was not inspected I would suggest you contact SEAI about the matter.

    how does the purchaser know that the house hasnt been inspected if they are not in possession of the house when the assessment is supposed to be carrried out?
