At this stage it is pretty much a standard requirement across Europe.

What actual regulations for what sectors state that employers who have ceased trading and cannot be contacted invalidates a background check?

One of the most strictly regulated sectors in the country for background checks is aviation. I'd say half the qualified staff in that industry have been laid off by a bankrupt employer at least once. Flybe, Monarch, Stobart, TEAM etc all had significant numbers of Irish based staff.

Legislation can also be challenged, but that would be rather outside the financial reach of most. Arbitrary discrimination and the right to a livelihood under the constitution.

This may be why they were only looking for 6 years of work history from me. Sadly I fell at the 5-6 year hurdle.

    Similar issue here.

There are job experiences from 10 to 20 years ago, I can reference with ease.

However there is this one experience between my last 2 and 4 years where I have issues with references.

Update: my former employer now issued a reference but the offer has already been withdrawn. I have contacted the hiring manager to see if they can reissue the offer, and he confirmed that the role has not been offered to anyone else, but is not sure if HR will override a previous decision. In the meantime, I have been interviewing but so far no offers though lots of second round interviews...

Any tips, suggestions etc? Would love to hear them,

The definition of useless red tape. Sorry to hear of your troubles... it sounds like a horrific company to work for, people covering their own ass to the detriment of the company as a whole.

Jeez I completely understand needing the background checks but sounds like the HR etc are a bit of a nightmare if that's their attitude.

Update: The hiring manager got his way. HR reissued the offer, I accepted and I'm starting the job on Tuesday. HR may be a nightmare, but the team etc are great. Thanks everyone for your advice and support.
