Newspaper using someone's name without consent.

    My mother was in an altercation where some teen's tried to rob it(they brought a fake gun) and she caught one and others got away. Can the newspapper use her name without consent even when she told the garda she didnt want to be mentioned by name?

    if it was reported in court they can. otherwise not sure. the garda has no power to stop the name being mentioned if it was reported in court. The judge possibly could, depending on circumstances

    If/when the matter goes to court, it would depend on the circumstances of the case and if there are media present in courtroom at the time.

    It is unlikely that the media would be interested in an attempted "armed" robbery but if the journalist hears that an elderly lady foiled an attempted robbery, it might make them more interested in the details.
    The matter should come before the district court first and judge will either accept jurisdiction or send it to a higher court, it could be done and dusted in weeks or could be 12months before it's heard.

    It's possible that the media will report the case but unlikely in my opinion.

    The media doesn't need your permission to name you in a report, they do not have to wait until there is a related court case.

    This report, if it was carried by a radio station or newspaper, would break no laws and would not be defamatory in any respect.

    Mrs Agnes Brown foiled an attempted robbery by two youths in her Phibsboro shop yesterday. One of the suspects was apprehended while the Gardai are searching for his accomplice.
