    Hi

    I'm hoping someone can help me with an issue I'm having. I'm currently dealing with wrapping up my late parents estate. There are two executors of the will. The other executor has gone to ground and is not communicating with me or the solicitor. There are still some things to be dealt with and money due to the estate that cannot be dealt with until the other executor engages. There is a decent amount of cash in the client account and due to the uncertainty over the other executor I've asked the solicitor to give me my share from the client account now rather than wait months to wrap the whole thing up. Can the solicitor refuse to do this until the case has been wrapped up? I've also suggested dividing an equal amount between both beneficiaries.

    Has the Grant of Probate been issued?

    A cynical reading of your post would suggest that you want to take your share of the cash now and you're prepared to leave the solicitor clean up the remaining mess caused by the other executor's refusal to engage.

    I'm not sure what you mean here, if there is a will it needs to be followed and if there is an intestacy it has to be split equally between beneficiaries. In what context are you deciding how to divide the estate?
