I am the owner of a retail unit that was leased out to a tenent but the lease has been ceased to to non payment of rent.
This was over 5 months ago and to this date he has not removed his equipment from the premises, I have had numerous calls to him to remove the equipment but has not done so.

I wish to rent the property out again what an I legally entitled to do with his equipment if he continues to refuse to remove it.?

You need to speak with a solicitor.

I'm not legally trained but believe you have given him ample opportunity, next step would be to issue a date and inform him items will be available for collection or will be dumped on X date, formal notice etc etc 5months is plenty of notice to get him to remove equipment.

Moderation: You need to consult your solicitor on this, legal advice is against the charter.
