Mortgage - joint or single

    Hi,

    I am curious about the following. There is only one name down on the title deeds but both of our names is on the mortgage. Can your name be on a mortgage even if you name is not on the title deeds of the property?

    If your name is on the mortgage but not on the deeds of the property but you have been paying half of the mortgage does that then give you a right to part own the property?

    Very poor form for a solicitor to not have registered both names on the deeds.

    Rights to property are not dependent on title on the deeds. There are many factors such as classifying as a family home or even simply paying towards it.

    Having both names on the deeds just simplifies the process of ownership when it comes to disputing issues around that.
