Unlawful arrest?

    Hi all,
    Just a quick enquiry. Let’s say you’re arrested for a section 6 offence as stated by the arresting Garda yet when you’re given your custody sheet it states you were arrested for something entirely different and no mention of the section 6. And let’s say the arresting Garda states in his statement he arrested you for this entirely different offence but thankfully you were actually recording him saying loud and clear he was arresting you for this section 6 *all hypothetical*.
    Would that constitute an unlawful arrest?

    What section and what act? I’m assuming it’s public order. If so one section is the offence, power of arrest is a different section.

    So it’s neither, clearly arrested for obstruction - that’s all that was said - yet no mention on custody sheet and Gardaí denies arresting for obstruction but a tax offence? As in vrt.....

    Sounds like Section 6 Public Order Alright. What section is in the statement? Section 24?
