Hi folks If i loose a Small claims case is it just the €25 i loose or do i have to pay the Other partys Legal Team?

When i lodge a Claim Does the Court get in touch with the people im bringing to court ?

Also can i cancel my Claim before the Date set for the court apperance if i want ?

No, it's just the €25 legal costs are not recoverable for eitherside.

Yes, but you need to make sure the details are exactly correct - Company Name, address etc. got from CRO

Presumably, but I don't know for sure.

Yes the clerk will get onto both of you to try and avoid it going to court and see can ye agree to a solution.

yes they changed the court im still waiting for a response from court now .

When Does the clerk get on to both of us to try to stop this going to court is it when they get there €25

Exhaust every possible solution with who ever your claiming against first before going down the small claims route it's not as simple as people think. €25 guarantees you nothing. Only your now €25 more out of pocket.

You'll have to make a written statement and the other party will be able to respond to it. You'll be give a chance to respond again and so will they if there disputing your claim.
If you did win in court (you'll have to turn up every time, they can pull a sickie a few times on you) you'll then need a sheriff to collect goods or cash to the value of your claim. The sheriff will also want to be paid by you.

It's a lengthy process if your claim is contested. Read my first comment again.
