Can one half of conjoined twins be found guilty of a crime?

    I believe conjoined twins are considered separate people so in light of this...

    Could one be found guilty of a crime and the other innocent?

    Could the other be made testify against the other?

    If the other is found guilty can they be jailed?

    Yes, unless on the facts there was some privilege or immunity to prevent this. But SFAIK there is no established privilege or immunity that arises simply out of being conjoined twins.

    As a policy matter, the state might think twice about calling prosecution evidence from the conjoined twin of the defendant. After all, it puts the witness in an appallingly difficult position. But, legally, they could.

    There'd definitely be a problem when it came to sentencing! I don't see that a jail term would be feasible, given the constitutional rights of the twin who has not been convicted of anything.
