maintenance - child with dad

hi There,

i'm a sole guardian of my daughter - dad has access (every second weekend and every second Sunday) and maintenance order is in place. couple of weeks ago he asked me if i would allow to have him the daughter for a week and I've agreed. he didn't take her on any holidays - she was at his place all the time (he took time off work). from what she told me they havn't been anywhere near fun places - cinema, zoo - anything. mainly staying at his place playing playstation.

to my surprise my ex not only refused to pay maintenance but demanded 50 euros from me to cover expenses that he carried on during daugter's stay. after i've disagreed to do that, he said that ok, i don't have to pay him but i'm not getting anything for the week.

when i talked to him he agreed that there's an order in place but this week is exceptional and he is not paying maintenance due to costs incurred.

im totally helpless and confused...

is there any way of sorting this out?

I would imagine the order has to be respected as a whole and one can't pick and choose from it.

I wouldn't make an issue of what they did for the week - the important part of care is spending time with the child, not that one must do particular activities.

Unless your level of maintenance is very high I would let it go this time but if it starts happening frequently you need to ask that the maintanence order be reviewed by the court due to non-compliance
