CVRT query

We have a fleet of vans here where I work. Some of which we bought off a hire company last year. We had them on long term hire and just bought them outright.

Long story short, we sent a van to the hire company last year for CVRT testing. We were told it was done and ready for collection.

We never got a disk for it, and to be honest it was forgotten about.It was assumed lost in the post, and it fell through the cracks to chase up on it. Until today.

The van was stopped at a checkpoint and pulled for no valid disk on display. I went onto the CVRT website and it turns out it was never tested. Driver has been given 10 days to produce a valid cert.
I booked a test within 5 minutes of the phonecall from our driver for this week.

My question is, will this new test be accepted or does it have to be a valid disk for today's date, or can we expect a summons to court as the van had no test when stopped today?

It is a genuine error, but I'm sure people would say yeah I've heard that one before. I have all the records to/from the hire company on the issue, would that make a difference if taken to court?
