Comreg forcing Eircom back charge ?

    Recently Eircom sent in a bill to the company I work for on the basis they had be undercharging us since 2000 on a line rental. The excuse was that Comreg were forcing them to reaudit customers as undercharging would be a breach...

    a) So are comreg really forcing them to do this ?

    b) Can they back charge if it was their mistake ?

    c) why can't they adsorb the cost ?
    Like the banks did with those off-shore account CROOKS (evading tax IS illegal - more so if I have to pay extra because of it)

    d) Has anyone, Anyone had eircom come back and say "as a result of a recent audit we over charged you two years ago - so here's your money back !!!"

    e) anyone heard from EAST on this ?

    It just sounds a bit strange 'cos the amount is quite small compared to the amount they could loose if we go carrier pre select. It is almost as if someone thought long and hard on the best way to annoy a customer..

    This has something to do with Eircom running anticompetitive discount schemes. Comreg have been quietly investigating the matter since September or October. Eircom were instructed to stop the practice in October/November 2002.
    b) Can they back charge if it was their mistake ?
    It was not a mistake, it was a deliberate undermining of the agreed pricing structure.

    They haven't a leg to stand on in standard contract law.

    a) They OFFERED you this discounted price. Remember that Call from the fella who said he was your Account Manager ?
    b) You ACCEPTED the discount :D
    c) You paid in full, the CONSIDERATION

    They must, you discharged all the agreed contractual obligations as they fell due.

    You were not evading tax or encouraging anyone else to, totally different matter.

    Never, Eircom doesn't do mistakes, but if they did..............

    Esat forced Comreg to investigate in the first place, they were quite right to do so.

    They are trying to keep Comreg from slapping a Big fine on them, thats why they are attempting to claw back all the discounts. This has been going on ......quietly.....for months.

    Ask Eircom to

    1. Audit all charges in the relevant period, not line rental alone.

    2. Show how and when the mistake happened and why it took so long to pick up.

    3. Recalculate all applicable discounts as agreed with your Account Manager fella way back when.

    4. Send a fully itemised and fully rechecked bill with all tariff and disount scheme changes marked off and detailed over the period of the mistake. This enables you to check their checking if ya se what I mean.

    6. Finally ask them what new internal procedures are in place within Eircom to ensure that there will never ever ever be a mistake liek this, ever again.

    CC the letter or email to Comreg.

    You will never hear about it again I suspect :D
