    Say a company trades under abc solutions......... okay and then they start trading under a new company name abcd solutions and they havent bought the name abcd soultions... okay


    Now some one Mr x. buys that company name... where does the original company stand with regards to Mr x. ???

    Mr X owns the name, and can stop you using it if he wishes. The information leaflets regarding the registering of a business name (as opposed to a company) are quite clear that registering a business name gives you no ownership rights to that name (i.e. you should still register it as a trade mark), whereas registering a company does give you ownership rights to the company name.     To a degree Mr X may be restained if the name is nearly identical to another's name. Passing off comes to mind.
