Do you think that built in clauses in T&C's that say if your going to be acting as a file server i.e. constantly downloading or uploading (could be a webserver, kazaa running 24/7 etc) that they have the right to reduce your speed or actually charge you for the extra priveledge or cut you off?

Not a cap, but service within reason?

You have to smile at Kazaa's attempt to incrase your usage in order to get a better "participation rate", i mean what that all about? Mines at 6 constantly! 56k damn it.

If your isp is giving you trouble tell them you work for an internet based video editing company or something similar. You need to transfer large video files to your collegues etc etc.

    -=edit=-
Your "participation rate" in kazaa can be increased without you participating if you know what i mean :P . Although i cannot say how here.

wouldnt they say then "get a leased line so if you want that priveledge" ?

I wouldn't say so. I thought leased lines were basically for people who couldn't afford their connection to drop. ( As isdn/dsl does). What isp is giving you grief ?? It also depends on their acceptable use policy, if its stated in their you dont really have any choice.
