    Withdrawal of Apology

    Joseph Murphy Junior

    ON 22 July, 2001, we published an apology to Joseph Murphy Junior as part of a settlement reached in High Court proceedings Record No. 1998 6498P, Joseph Murphy Junior v. Independent Newspapers (Ireland) Limited. We also paid to Mr Murphy a substantial sum of money in settlement of those proceedings.

    In those proceedings Mr Murphy claimed that he had been libelled by a Sunday Independent article which suggested that he was present at Ray Burke's house in June 1989 when a substantial cash payment was made to Mr Burke. As the law stands, we had no choice but to settle our case with Mr Murphy we would never have been able to legally prove that he bribed Ray Burke. Mr Murphy denied having ever been present at Mr Burke's house or having had anything to do with the cash payment.

    The Flood Tribunal has now concluded that Mr Murphy was, in fact, present when the bribe was paid to Mr Burke and that he and all other persons present at that time were aware of the corrupt nature of the transaction. In light of that finding we hereby withdraw our apology to Mr Murphy. We will be taking urgent steps to recover from him all money paid to him by us, together with our legal costs, interest and damages.

    Class. For once, I'm firmly on the side of the Indo. Sock it to him lads. And I want to see regular Charlie Bird style reports in the paper letting us know about progress on getting money back from Joe Murphy Junior (hereby known as "the wally") who was in Ray Burke's house while Burke was being bribed

    See - we can all say it now:D

    I hope they get every cent of that back.
