Not quite, but I do th ink the process should be thought out.

If you are going to use Military Courts, you are recognising them as soldiers accused of war crimes, not terrorists accused of murders.

if you do recognise them as soldiers accused of war crimes, then the ICC (International Criminal Court) would surely take action and the not the millitary court? but then again, the US government opposes such a court from ever existing very strongly.
