    You should get paid for it if you were supposed to be working that day.

    Well I work every weekday 9-5, its just that the actual place was closed on the bank holiday.

    Yes, then you should be paid for it.

    Once you've clocked up your 40 hours in total in the previous 5 weeks then you're entitled to the day off. You've obviously done this so you qualify.

    The lay clearly states the following.

    If you normally work on a monday then you should be paid a full days wage for the monday. If you do not normally work on the monday bank holiday then you should be paid 1/5 (20%) of your average weekly salary.

    Your average weekly salary is defined as the averager weekly pay over the last 14 weeks.

    Less clear is the following
    1) If you have been working less than 14 weeks not so clear if you should get the 1/5. but a good employer should have made this clear when you started work.
    2) Does the weekly salary include overtime, well in fact it should, but very few pay it.

    Moving along a bit...

    Who is to say whether someone is "full time" or "part time"

    We all know the examplars 9-5 every day and a few hours a week

    But to be technical who/what is the authrity that rules either way, and what implications do the designations have?
