Today i received a nice letter from the Circuit Court and the Bank of Ireland governor, inviting me round for a chat within the next 10 days.

Well not really they screwing for 7 grand i owe them :(

1st off i going to a solicitor 1st thing monday morning, the debt i have with them and others i have been paying tru Mabs for that last 18 months or so but the BOI find this unefficent and feel that dragging me to court will get them their money faster. In reality its not going to happen as 1 i dont have 7 grand if i did i wouldnt be in this position and 2 i dont have 7 grand.

Atm i have record of payment to mabs for the last 18 months but its only small amounts to BOI the majority goes on the mortage for the house the kids live in (i dont live there anymore but still pay it) That being priority over everything else. Now i get paid weekly and money goes directly to 2 mabs accounts one for creditors and one for mortage, every week this happens without fail. I have had 3 jobs in last 18 months so there has been slight break in payment and i found im a Jonah, if i join your company it will go bankrupt (2 out of last 3 ) present one seems ok but im sure i bankrupt them soon.

What can i expect to happen? Afaik i go judge dude asks if i have the money i empty pockets and give him Oliver twist look, then tell him about Mabs and other creditors who want my balls on a stick. He then says 1. Come to an agreement and stick to it or umm well i dont really know , its a Civil Bill so i wont be doing any hard time or ever getting a loan under that identity again :D

Anyone else went down this sad lonely road, btw i totally blame Fianna Fail for their insistence that family values should be crushed and anyone trying to raise a family correctly without ripping of the social welfare should be punished financially.

    Oliver

Man I'm sure the judge will take a look at your overall situation and the fact that you've been coping admirably with these pressures and set backs. Good luck with it, (and you're right to blame FF, they waste 3 million on a photo shoot and you get called to court over 7 thousand? pack of jokers).

Talk to MABS also and bring along your file.

I hate to see people in this position. I'm sure the judge won't be harsh and will take your situation into high consideration. More than likely the court will order the same Mabs payments to continue and will politely instruct B.O.I to accept this....worst case scenario, Mabs payments to B.O.I will be increased slightly.

You are doing well and respect to you for putting your kids at such a high priority and looking after them.

Your a decent person and i wish you the best of luck

btw i totally blame Fianna Fail for their insistence that family values should be crushed and anyone trying to raise a family correctly without ripping of the social welfare should be punished financially.

That's the most frustrating part of it all...It would be easier to just be a low life, screw over your kids, screw over the system etc. etc. ... But I'll save that for the politics forum (and elcection day)

I really feel for you, and it seems such a frustrating situation to be in. I think you have a great attitude though, and are handeling it well.

You say you're paying a mortgage and you don't live there, so presumably you are paying rent somewhere else? If this is the case, is there any arrangements that could be made to rectify this in the short-term, as I'm sure that is a substantial amont of money going out.

It seems odd though, that you have a consistant payment record of 18 months, and the debt is only €7000 (by only I mean there are much bigger debts out there of course).

What's your credit history like? And are you covering the interest? Is there any security on the loan?

My advice would be to chop up the credit cards, tighten your belt as much as possible, and try to cut as many costs as possible (Accomidation possibly being a major one). But you know all this already.

I don't think the judge is likely to do anything other than impose a mandatory payback amount per week/month, and he will deffenatly not put that amount outside of your capability, because that is a unsustainable court order (something like that...your solicitor will be able tell you all about that stuff..) Nothing much will change from your current routine of installments, possibly slightly more, but nothing extroadenary...
