Not sure if this was already posted here or elsewhere.

    Woman countersues RIAA.

This could be a very interesting case if it isn't mysteriously dropped.

HAHAHAHA. Don't think this one will mysteriously disappear.....it's the EFF that have taken the case on her behalf. Can't wait to see this one play out in court. It's like the OJ trial for geeks. ;)

Indeed, and the RICO laws in the states have teeth, having been brought in to combat the mafia and all if I recall.

Looks interesting, the problem with things like this is that the record companies can throw so many lawyers at it that it could get bogged down in red tape for the next 10 years, kind of like the SCO vs the world case.

    Technical query.
Was the RIAA claim made just on the basis of IP addresses or on content on the HDD. Would there be any chance that she didn't have a static IP and was the victim of mistaken identity? Was the time on her clock correct or where did they get the timestamps for the IP they used ?

I think basically what they do, starting off anyway, is to scan P2P networks for people sharing files. They can then get lists of IP addresses through the P2P network. They can then send the lists along with the relevant times (and court orders) to the ISPs involved and the ISPs can check their logs to see who was assigned each IP address at the time involved. In theory the ISPs are supposed to maintain accurate logs of which customer is using which IP address.

Just thought of something. Seeing as most companies have politicans in their pockets, its feesible that a law may come into effect making it legal to hack into someone's PC if there is reason to believe there is a MP3 on it. If this goes throught, it'll be then legal for everyone to hack into the US Militarys computers, as the "law biding public" were "fearfull" that there may be "illegal congs" on the military's servers... :p
