Some of you may remember my threads about getting a refund from Aldi on a laptop I bought there and buying a new Acer one from MicroAid.ie which had a fault with the sound dropping out.

I bought the Acer from MicroAid around the 5th of August and reported the problem to Acer on the 9th or so. It took me a while to get around to arranging them to pick it up but they did last week and I rang them today, when it should have been returned, to see what the story was.

I just got a call back saying that it's on its way back to me with.. "no fault found". I knewwww that was going to happen. I explained (even made a desktop background explaining) the problem with the sound as much as I could have. So the engineers found no fault and are sending it back "unrepaired" due to there being no fault after a diagnosis.

Now 28 days is long up. MicroAid said they need confirmation from Acer that the laptop is faulty before they can give me a refund. Acer have found no fault so basically I'm getting back a laptop with a definite problem.

I was asking the guy on the phone what can I do. He said he'll give me a call Monday evening (it's supposed to be back monday some time) to see if I can still find fault with it, if so, I will have to send it back.. again.. to the same engineers asking them to pay "special attention" to it. So I'll probably be without my laptop for another 2 weeks or so.

Where do I stand does anyone know? I want to just tell them where to go and get my money back but I don't think I can. I also asked what's the story if I refuse to take it back and he said something like it will go back to their store until I'm prepared to take it back, something along them lines anyway.

    Any advice pleeease!!

If it wasn't in your possesion for those 28 days you should be ok. Your guarantee shouldn't run out while they have it in the shop.

    Hi, thanks for the reply,
Unfortunately, I only sent it back to Acer about a week ago, the 8th or 9th and I bought it around the 5th, so that's more than 28 days :(

I feel for you dude... that would be my worst nightmare.

I sent back my PSP to Xtravision yesterday because it has about 10 to 20 dead pixels. I'm hoping they dont give me the same sh1t MicroAid are giving you.

    Good luck...

Is there a fault with it that you can point out and say: Look Microaid this is a fault.. deal with it!?!

If there is then I suggest you say just that to Microaid. Take no sh1t about Acer. If there is something and you can point it out there and then in the store then you are on solid ground.

If it is a rotten intermittent problem then it gets more complicated, and often it comes down to the good faith of the store. I know a person who had a HP laptop and it was sent back to compustore so many times but they said there was no problem (even though there clearly was). He got it fixed in the end.

thanks for the replies, yes I would be able to point the fault out to MicroAid, but the 28 days is up and they say they need confirmation from Acer that there is a fault, I'm thinking I would be wasting my time going in.

Is there any law in favour of me here or am I funked because I held on to it too long before sending it back to Acer (I was busy and needed the laptop and just didn't get round to sending it back, I was also trying to search for a software solution for the problem). But yes, there is a fault I can point out, but it's been about 40 days or so since I got it from MicroAid.

The laws haven't changed since your Lidl/Aldi laptop problem. The 28 days doesnt matter.

I thought the law was that it had to be within 28 days and that Aldi just had exceptional customer care and they didn't actually have to refund me for the laptop I got off them? I'm pretty sure I read that it's only 28 days that the law is on my side for a refund

Well I got it back today anyway, they reformated my HD, which there was no need to do  and they also put a few dents on the lid   As well as that, the sound is still the same, still faulty.

Should I return it to Acer or should I go to MicroAid? At this stage I'd really just prefer to get my money back and go and get ANOTHER new one, sooo annoying.

Whats wrong with the sound? it may be a crap driver issue.

I've tried many different drivers, I'm 99% sure it's a hardware fault. It's not that obvious but it's the kinda fault that when you'd be listening to music, you'd be almost waiting for it to happen again, it totally hinders a music listening/dvd watching experience.

Is it a white noice type sound? Or fuzz like interference?

I recorded an audio file from the line out to my MP3 players line in recorder and put the sample audio file online where anyone could download it and they could hear the exact problem for themselves, unfortunately I can't find it without the search on boards.

It's not a constant sound, its as if there was a master mic when the artist of the song being played back were recording their album and every few seconds the sound engineer tapped the mic. You know that kind of sound when a mic is tapped, it's like that when the music is playing. It's definitely not the audio file either as it happens with everything. I think it's a matter of legal stuff now. Are they allowed dent and scratch my laptop lid like that and get away with it???

If you can prove that that wasn't the condition it left you in then no they cannot get away with it. Also they shouldn't be allowed to format your HDD without saying it to you first so you can back up your files.

Well I can't really proove it wasn't dented or scratched before I gave it to them:( I suppose all I can do is complain  To microaid or Acer though?

Well microaid sold it to you, they dont provide support. You would want to get onto Acer yourself and give them hell

Thats your choice. I'm sure I mentioned the relevant legislation in the previous thread in relation to Aldi.

Its sickening if they damaged it while they had it. You really have to go to Microaid in person and have war. At least that is what I would do. And if that fails try acer, and if that fails i'm afraid your only option is the small claims court.

It rarely ever comes to that.
