Direct payment from ex employer re outstanding pay

    I found out my former employer, whom I left 2 months ago, owed me many days in outstanding holiday pay.
    After chasing them down for that period (and threatening legal action), they finally agreed to pay up.
    I got an email confirming the details - I was due €X, but they were applying the emergency tax rate and deducting PRSI and leaving me with €Y.
    I didnt question how this was going to be arranged, and thought I'd stand back and see how they'd do it.

    Yesterday, I received a direct transfer from them of €Y.
    Now, what has happened to the rest?
    As I will not get a payslip and there's no record of the tax being applied, how can I claim back?
    Is this verging on an illegal practice by my former employers?
    What should they have done?

    Get the exact transaction in writing, explaining gross less emergency tax which gives you what you received. Also call the revenue for exact procedure on 1890 20 30 70. You'll be able to claim it back at the end of the year, just not sure how but the revenue will clear it up.

    what they should be doing is giving you a new P45 stating the amount of money earned during the last years employment (you prob already got one...so they should give you a second one that is updated to take account of the outstanding holiday money owed.)

    They are probably correct to apply the emergency tax rate to these earnings (but am open to corrections)...

    if they dont give you a new p45 within 2 weeks contact the revenue and make a complaint.

    keyser - all I have is an email. Should I demand a proper written doc?
    I was waiting until I sorted out this issue, as I've actually other tax I need to get back. Will I have to wait long once I explain to the tax office?

    In honesty, I was expecting a new P45, like bull runner mentioned.
    this would be much clearer. I dont know why they did just say "ok, we made an error... dump your old P45 and well do it up again with the amendments".

    So they are giving you Y and keeping X for themselves.. I have a feeling Z has not been declared. I would screw them over for being smart...

    Agreed, tell them you want a full breakdown and a new P45. If not forthcoming squeal to the tax man. :D

    I've got the full breakdown in an email alright.
    I've now requested an amended P45 - this should show their willingness to declare the amount and correct my final figures.
    Will be interesting to see if they reply.
