should i take a uk seller to small claims court??

    hi i was robbed from €43 on ebay from a scottish seller and am considering summonsing the seller to small claims court here as i understand he doesnt have to be in the same juristiction inc country.

    the only trouble is even after ruling in my favour i may still not get my money back. It could be a waste of a further 9 euro and i dont even know if this guy is even alive as needless to say his replies stopped a long time ago.

    i know of at least 20 other times of his deception
    all paypal have done is locked his account until he refunds me (as if he ever will)

    anyone with previous experience of small claims process with regards to items bought on ebay or indeed did anyone ever get a refund after a long period of time.

    Id like your 2 cents

    Your 1st port of in all this should be your credit card company and dispute the transaction (assuming you paid Paypal through your credit card). I assume that the credit card companies in Ireland offer online shopping guarantee. It is standard over here.

    In these situations, I ignore ebay and paypal as I have found them to be next to useless and go direct to my cc company.

    As for the small claims court, it really is a waste of time because of the sum involved and the fact that he is in another country.
