Check-in charge ruling blow for DAA
    April 08, 2005 18:30

The Commission for Aviation Regulation has said it cannot consider an application from the Dublin Airport Authority for retrospective approval of rental fees for check-in desks. This means the airport may be left owing almost €2m in fees it charged the airlines.

The DAA, formerly Aer Rianta, had been applying the charges since 2001 and October last year.

The fees were the subject of court challenge by Ryanair. That challenge was initially in favour of Aer Rianta but was subsequently overturned. This caused the DAA to seek retrospective approval for the rental fees from the regulator.

In a notice today, the regulator said that, following legal advice, it had told the DAA it could not consider such an application. Under EU regulations, approval for such charges must be sought in advance.

On October 6, the regulator approved the rates to be charged by the DAA for check-in desks at Dublin, Cork and Shannon from that date. Ryanair is currently challenging this decision in the courts.
