    howya ,

    i'm lookin for some advice on my job :( :

    i work in a centra , mainly the 6 -10 shift at night .
    me and my mates who work their , are being taken for a ride every 6-10 shift we do , as at the end of it , we stay for min : a half an hour to 50 minutes - we mop the floor and told were not allowed leave for security reasons :rolleyes:
    were not paid for the time we stay back , and i want to do something about it , what are my rights :confused:

    some of my mates are afraid to speak up to management about this for fear of getting the sack :rolleyes: , but sure that would be unfair dissmissal right :confused:

    i would'nt mind -they got a clock in system in work , and we were supposed to get paid by our time on that but ive found out we don't so all there using it just to watch the time we take on our breaks :mad:

    i'd be very grateful for advice - bearing in mind i don't want to quit .

    this basically comes down to principle , and the fact that over a year say - we are being robbed bigtime :mad:

    Your 17 right and its not going to be a career in the centra for life now is it? You have to get paided for your time you put in no matter what you do,especially if its a clock in system.

    Talk to manager and tell him in a firm but nice tone that your not getting paided for the extra min/hour your putting in and you want it back dated if there is any.Is there a HQ you could ring to ask about why your not getting paid what you've worked?

    i'm not being a pussy !!!

    nope definatly not a career for life ! managment told me we have to stay back , and i just keep getting the cold shoulder from them .

    there's no HQ to go to : thought i will say somat to the manager as mad said 'a firm but nice tone '

    say if they told me i was sacked ?? what rights do i have and what could i do about it ?

    Now I'm not suggesting this, but if you were to leave because of this issue you may be able to claim "constructive dismissal" which is essentially the same as unfair dismissal but you must prove that the employer left you with little choice.

    Of course, I presume that in a court of law you could sue for all those hours that have not been paid, and while I dont know your personal situation, if you arent working there that long it could be done through the small claims court, at a total cost to yourself of €9 (afaik)


    There is the other road of simply walking out at 10 on the dot each night, and if they force you to stay you are being restrained against your will.

    Or if they make you stay, simply refuse to work without being paid.

    Frankly, I wouldnt be afraid of them firing you, as it sounds to me like you would have a strong case for unfair dismissal. Not something an employer would want to deal with.

    Of course as per the other advice given here, be firm but polite in all your dealing with the management, and don't threaten them. This only weakens your position in the long term.

    you should mention this on the work forum mate, theres some very knowledgable folks there that will tell you the names to drop to make the management **** themselves :)

    regarding the small claims court : i've been there about 9 months now .. never thought the small claims court dealt with the work side of things .... do they do that constructive dissmissal thing ?

    thanks alot - hopefully i'll get a result without threatning the small claims court .
    As I said, try to avoid threatening them, this will probably undermine your position, and they will actively look for a valid reason to fire you

    Well, I have to say, if someone said that to me, that ios exactly what I would do (and im only a student, but did have more different managers, assistant managers and trainee managers in only one shop over the last three years myself - most of them total eijits)
