    I've noticed for a while that when, for example, you ring Dell, Eircom and alot of other companies, I often hear the following or similar...

    Your call may be recorded for monitoring purposes.....

    Is this legal...?

    Anyone any views...? This I find bothersome....

    I think they say "training purposes" and it's perfectly fine in my opinion...

    can only help them make their phone people a little less thick headed.

    You should also record it and when speaking to customer service dude tell them your recording this call for consumer awareness reasons.

    Its legal if they tell you. Actually my work all calls are recorded (in and out) however they are rarely if any listened to. Its more for auditing purposes.

    If you are recording conversations on the phone it is illegal if you do not tell the other party, or the phone does not tell them. For example if you hear a beep every few seconds it generally means you are being recorded.

    Does this apply to any phone call? Or just one that involves a company?

    Does the same apply if you're face to face and have a little dictaphone in your pocket or whatever?

    Does this cover VOIP too?

    Yeah I heard this is true in Ireland. Something to do with libel laws and protecting civil liberties.

    But supposedly it causes major problems for our intelligence gathering services, ie the Guards/Army and even the Brits IIRC, as any info they glean from a 'tapped' phoneline cannot be used as evidence in court, like in America, as the offender wouldn't have been informed that he was being recorded.

    It is used tho to provide background clues so the detectives can find some proper admissable evidence.

    This is supposedly how the Guards 'know' who the Omagh bombers and NI Bank robbers are.

    Basically, I'm told by an automated message, "Your call may be recorded for monitoring purposes..." I'm not asked, warned etc... I have no choice if I wanted to avail of the offered service.

    My privacy is intruded upon because I want to avail of the service.

    OTOH, I guess in most stores I visit, I'm on CCTV....

    Just interested in other peoples views....

    I suppose while the customer reps. know the call is being recorded, they talk to you like zombies, its sometimes rare if you just get a straight answer out of them and if they talk to you like a human

    As far as i'm aware, (from my time working at Compaq/HP, and my mate working at Dell), all incoming calls to the helpdesk numbers are recorded. They are primarily used when calculating the helpdesk agent's performance related bonus - calls are randomly selected and listened to by a HR drone and the agent's 'supervisor' to assess the agent's technical knowledge, customer handling skills, ability to achieve a first time fix, and such.

    The people who listen to the calls are not really interested in you, the customer, only how the agent deals with your call (unless, of course you are threatening to fire bomb their office or something).

    If you don't want them to use the recording, just tell the human who finally answers the call that you do not want the call to be recorded (they'll still have the recording, but they can't use it for anything, not even training purposes)

    They're recording REQUESTS FOR TECHNICAL SUPPORT. To help give better support in the future. It's not as if that recording does you any harm... and of course you're entitled not to avail of the service if you don't want to.
