okay, i've had a few jobs in the past that did'nt work out for whatever reason, was unemployed for some time and was desperate to get back to work, so recently i started a new job and well tbh i'm only there 2-3 weeks and it already has Dodgy written all over it to me. Now i'm not going to name names or anything like that but let's just say it's a marketing company adn leave it at that.

First off, not sure on the legallity of this and would like some other opinions on the matter but getting paid daily but more importantly Cash in Hand....is that legal, i thought the whole cash in hand thing was not exactly legal for one simple reason, no tax. that's another thing, i ain't paying tax which is making me even more suspicious about this place. On our daily invoices there is in the top corner a VAT reg. box but in it there is no VAT reg. for the company just says TBA.....hmmmmm

Not too keen on the hours we have to put in either, 7:30am-7:30pm mon-fri are the hours i was told in the interview, so far i think i've gotten out twice at 7:30pm usually it's more like 8:00-8:30pm so that's a good 12-13 hr day and given that i have a 30min drive both too and from work it makes for a physically exhausting week (60-65hrs...is that legal?)

as we get paid on a daily basis (something like commision but not quiet) it means no holiday pay, as i was sick on the week leading upto xmas that meant no work...no money and well a pretty sh*tty xmas with €30 in my wallet from xmas week until now.

going back to work tomorrow and i really dont want to but i can't afford not to be working, this business just seems so dodgy but they always seem to have an answer for everything when you ask them about it *sigh* gotta go job hunting again this week big time and try get out of there. Can anyone point me in the right direction in terms of finding out for definate wether half of what this company is doing is even legal?

ok. this one sounds a little muddled. you seem to be mixing the work and its conditions with some sort of legal position, but lets see if we cant untwine them!

first things first, have you signed a contract, and have you actually read it?
i ask this, because of the hours you are working. EU directive says you cannot work over 42 hours (i think, it could be 40, it could be 48) on average a week (meaning you can work 4 x 12 hour shifts one week, and 3 the next). you are currently contracted to work 60 hours a week. this is legal if you have signed a contract saying you are waiving your right to the above law. its perfectly legal. how long it takes you tto get to work is your own business, and does not enter the equation. sorry.

cash in hand is illegal, but is this place a new start up or something? they have no vat number? i can only think its a new company and had not received a vat number when it came to printing up paper. do you get a pay slip? you are obliged to receive a payslip for all work done. its the law :)

with regards the no sickness pay, i suspect youare on a contracting job. which means all tax etc has to be sorted out by yourself. no sickness pay is another great bonus of working contract.

what sort of questions have you asked them that they have had an answer for. obviously you dont like the answers you have been given, so i am unsure what it really is that you are unhappy with to be honest.

from you post, i actually cant see anything illegal if you are in a contracted position.
if you can tell us what exactly is that you are unhappy with, then maybe we can look at that.
if you have direct questions, then maybe we can answer those.
