ISP data retention requirement

    Hi Lads,

    I know that ISP's are required to keep certain traffic data on their customers activities, but it's been a while since I read anything on it.

    1./ What data is kept? (IP logs, URI's, more?)
    2./ How long does this data have to be kept, by law?
    3./ How long is it kept in actuality?
    4./ Who has access to it? (Gardai obviously, other bodies?, public FOI request?)
    5./ What is required to access it (court order, FOI request, nod and wink).

    The last I heard there was a little confusion with two contradictory laws, one relating to child porn and other to user privacy...

    Anyway AFAIK they are not allowed to hold Named data - ie. the logs can't say Fred visited such and such a site. They MUST keep certain IP data, ie that this address (possibly tracable to Freds computer) visited this site at this time.

    As for more details and data retension time, recently there was a move to keep ALL emails for ~5 years, but I think this was dropped.

    sounds alot like "permanent wire tapping". Keep logs or copies of everything and you wont ever find your self in the need to get the information ethically.

    Reminds me of when they built a tower near sellafield - the locals wanted to complain but then found it had nothing to do with BNFL - it was MI5/6 and they didn't need planing permission.

    The tower was to eavesdrop on the microwave link between Eircom and BT.
    So it might not be just the ISP holding data.

    Also if you use Satellite Broadband or Wireless broadband (or pagers) all packets are can be intercepted en route. (gsm scrambles packets so not trivial to eavesdrop)
