40sqm rear extension

    Hi-I am based in ongar and planning to get house extension upto 40sqm.I have heard that 40sqm is exempted.Can anyone pls help - Is a 40 sqm rear house extension exempt from planning permission, or are there still conditions that need to be met?

    Thank you,any idea about point 2meters from neighbour boundary if above ground level.Its confusing as I have checked with different people and everyone saying we will go with 30cm from neighbour boundary.

    "Above ground level" means a two storey extension.

    Is that what you are planning?

    Ignore those people. Requirements are all on the link, it’s depends on 1 storey or 2 story, windows or now. It’s never 30cm

    Here's the legal document covering exemptions. Your extension falls under class1 as shown in the left column with the list of conditions shown in the right hand column

    Ongar is a high density development.
    Gour parent planning for the estate may prohibit exempted development.

    Also your back garden needs to be 25 Sq. M after the extension. They were small back gardens up there to begin with last time I was in one of them.

    May be different types so it would be worth getting a local planning agent out to guide you, if even to mark on the ground the max extension you can build.

    Thanks also can you help with insurance ,I have heard that if we go for flat roof let's say 38sqm then generally for more than 25% flat roof area they are not ready to give insurance.My full house floor area is 128sqm pitched roof but in extension if I need to calculate 25% will it be full floor area+extension or only ground floor area+extension ?

    No idea about the insurance aspect. You should ring your insurance company and discuss the matter with them.

    The percentage is calculated on the roof area.

    The are many insurance companies out there which insure you. You might have to pay a small extra, but you will get insurance

    Thanks all,last question : We have decided to have 2 bedrooms both with ensuite and kitchen in around 38sqm and still we have lot of garden space left more than 25sqm open space left that we are planning to cover with tiles.There are rules about height,window etc but nothing around if kitchen and both room with ensuite allowed is it exempted as well.

    What rooms are in the extension is nothing to do with planning.
    Rules about window are applicable here.

    Building regs apply separately (not a planning matter).

    Thank you guys,appreciate your help.Is there any certificate or anything else I should be aware of and ask from contractor just if we sell property then what type of proof to be provided that property is exempted and under 40sqm compliant as I am directly starting work and not taking anything from council.

    I know that an architect's or engineers or technicians cert in relation to planning would have been acceptable in the past but I'm retired now so haven't kept up to date with current requirements. I have heard stories that certain lenders no longer accept this form of certification and require a Section 5 declaration from the local Council which might be your best option. It entails submitting basic plans and maps with 80 Euro fee and if all is in order they give you a cert confirming the works are exempt. Usually takes about 6 weeks.
