Six months is up for Garda to File.

    I understand that a Garda has six months to file the case to the district court and then could be another few months for the summons to arrive.

    Today marks six months since the the incident happened. As above I fully understand the guard could have filed it yesterday and might have to wait a few months for a summons.

    I’m just wondering if it’s worth getting a solicitor to contact the gaurd or the district court to see where the case is at and if it didn’t make it past the DPP and just thrown out. It’s really for piece of mind. It’s really not a straight forward one and there is a severe lack of evidence on what there trying to prove or for me to be found guilty.

    I won’t be contacting anyone only a solicitor probably. basically asking is it worth bothering a solicitor to see if they can see where it’s at. I don’t want it hanging over me any longer.

    Contact a solicitor when you get a summons, unless there is some factor in the incident which would require you to gather or preserve evidence.

    DPP doesnt make the decision to prosecute in most District Court cases - its usually the local Superintendent.

    As a rule of thumb, I wouldnt advise contacting the Gardai for updates. Quite often they forget dates and deadlines or dont bother because they're busy - you'll only be reminding them!
