Conveyancing Issue

    Hi, I wonder could anyone shed some light on the below scenario as we are at a total loss..

    Nov/Dec 2018 - Went sale agreed on a property. We appointed a solicitor who other family members had history with. Sale went fine.

    Jan 2019 - Moved into the property

    March 2019 - Solicitor emails to advise they have stamped the purchase deed and arranged to lodge with the PRA

    March 2023 - Our bank send a letter to us saying they have been unable to obtain the deeds from our solicitor and can we chase it up directly with solicitor. Solicitor responds to advise the purchase deed had to be re-signed by the Vendor and the docs will be relodged with the PRA.

    May 2023 - We chase solicitor. They advise the docs had to be re-lodged again as the PRA raised a query

    June 2023 - April 2024 - We chase solicitor, emails go unanswered

    April 2024 - Response from solicitor saying they will ask the PRA to expiate

    May 2024 - Oct 2024 - We chase solicitor, emails go unanswered.

    Nov 2024 - Revert to phone calls, solicitor requests we attend their office. We attend expecting an explanation of sorts but we are advised we need to re-sign the purchase deeds to be lodged with the PRA. No real explanation offered, other than its normal and the PRA are difficult raising queries all the time .

    Jan 25 - May 25 - numerous calls chasing solicitor, its always either just been lodged and we'll hear something in a couple a weeks or there's been another PRA query. Last call was mid may and we were advised its in with the PRA.

    We really are at a loss as to what's going on here.. As far as I can see the purchase docs have been lodged 10+ times at this stage. We are actually looking to move house which I said to the solicitor, and they said that would not be a problem they can do a 'side letter' or something, In reality I was blagging at the time and trying to light a fire under them. But we actually are now looking to move.

    Do we;

    1 - go to another solicitor and try to engage them to sort it out

    2 - raise a complaint with the Law Society (dont know if this is applicable)

    3 - Wait it out with current solicitor

    Do we have cause for concern here?? 6.5 years in the house and its not legit with the PRA?

    the PRA, now called Tailte Eireann don’t raise difficult queries, the solicitor must not have lodged the application properly in the first case, a straightforward transfer does not take that long to be registered

    Thanks.. the solicitor has said it goes from one desk in the PRA to another to another and they all can and do raise queries and each time its sent back to her to re-lodge! (the only info we have is from the solicitor I would imagine I cant approach the PRA or Tailte Eireann directly to query?)

    The only other consideration I think that could potentially be causing an issue is we have a shared driveway with our neighbours which we knew from day one and was coloured in yellow on the plans. Could that be the source of the issue?

    Is it a first registration of a previosly un-registered property. Is it a sub-division of an existing Folio or is it a straight forward transfer of an existing Folio?

    My understanding is its a first registration…ie unregistered.

    House was built c.2003 and only had one owner since construction until we purchased in 2019. No sub-division or anything like that.

    Just because it was built in 2003 does not mean it was unregistered.
    When you look at landdirect.ie, does it show the site as unregistered?

    First registrations can be very slow, particularly if there is any ambiguity with a map. TE are notorious for sending applications back saying they are invalid without specifying what is wrong.

    if you have a folio number it’s not unregistered
