Replacing managing agent

    Looking for some advice please. I moved into a very small development 18 months ago and immediately discovered a lot of dissatisfaction with the managing agent. The development is approx 20 years old and he has managed services since the beginning. He has two landlords on the BOD who don't live on site and seem to be close friends with him. Initially the fees were approx 1000 pa but over time have spiralled to 3500 with higher costs for those in the penthouses. He's not maintaining the development very well and is very aggressive when queried about anything. Most of the residents are retired and really don't want to engage in any hassle with him. I was asked to go on the board by some residents, I agreed at the AGM last May. There hasn't been a single meeting and no communication directly from him. I have queried him on a number of occasions, including the other directors in the email about the status of payments from one resident who is a serial non-payer. This owner didn't pay his fees from the start but it was 2017 before the agent took any action against him. There is a court judgement against him and he is now paying a monthly amount but there is still over 45,000 outstanding (this includes legal fees and interest).

    I emailed him a few days ago asking when he was holding the AGM and he eventually replied giving me a date in late September. Some of us have met with another agent who would be happy to take over the role. We intended on proposing the change at the AGM. Can we force him to call the meeting sooner?

    I really didn't want to get involved in any disputes as I'm retired and just want to chill and enjoy my home. But, I'm now getting angry at this guy and feel we're being taken for mugs. He's elderly himself and very rude to deal with. The other two directors haven't responded to a single issue I've raised so won't get any help from them. Not sure on how to progress this so would appreciate some guidance.

    Firstly, the managing agent doesn't decide when the AGM is, the directors do.

    You can propose an EGM. Get the majority of directors on board, agree a date for the EGM, notify all shareholders (i.e. the other occupants). Tell them that you will be seeking a vote to "change managing agent" (or whatever suitable wording) and that your intent is to improve services and save them money. Enclose quotes from 2 or 3 other agents. Convene AGM. Job done. YOU DON'T EVENT HAVE TO TELL THE MANAGING AGENT, except where contractually required to serve him notice. Check the managing agents contract, it is probably 3 or 6 months notice. EGM today, 3 months notice tomorrow, new agent 3 months + 1 day from now.

    Thanks so much for that. The problem is that the other directors are likely to support him. They have done nothing for the development and just stay on the board every year without asking any questions. I suppose I can contact the other owners and seek their support. I'm not sure of the position re his contract. I understand he's just back in at the AGM each year.
