Right of way

    Hi all need help on this

    I have been approached for a right of way through my land to get to a forestry. I have a roadway that goes 80% there but the forestry lads are looking to extend the road to reach the trees so they can extract. They have no access road from any other area. Now if I give them access and they extend the road I will forever loose those farm payments on that bit of land. Prob €100 per year but for life.

    My question is this for the hassle, inconvenience, roadway extension and right of way forever more what would be a fair level of compensation to be asking for?

    Check if forestry is classed as a commercial enterprise and not considered farming, I would be slow to give them a legal right of way which is indefinite, could you charge them for access just to harvest, how did they manage access to plant the trees in the first place

    Get legal advice, but I'd be inclined to look at a licence and keep them on a short lease
