Appealing a ban in Radio.

    I would like to appeal the above on the grounds of:

    a) it is excessive to ban for this when a warning and deletion would suffice

    b) it does seem like a retaliatory action in light of the fact that this very mod banned me recently (also in radio) and this ban was removed upon appeal.

    I did try and resolve this with the moderator but was unsuccessful in resolving the issue.

    For context this was in the Liveline Thread and posters were offering suggestions as to what they’d like to see in the remaining shows that will be hosted by Joe Duffy. Keeping with the spirit of the suggestions my post was a light-hearted suggestion for a show topic before Joe’s departure - as was obvious by the manner in which the post received by the audience with one poster commenting on how amusing they found said post.

    Discussing the “RTÉ Scandal” is forbidden and I accept that, however I didn’t mention the scandal directly (there is ample evidence of waste within RTÉ outside of the scandal) and the bailout is not wholly related to same, while the licence fee remains a taboo subject/no go area for Liveline.

    I’m rarely in the Liveline Thread so it’s not like I’m a repeat offender on this topic - hence why I believe a warning would have been sufficient and a ban is wholly excessive.

    I asked the mod via PM politely would downgrading it to a warning not be more appropriate but they were not for turning.

    This moderator also banned me 2 weeks ago - a ban which was overturned on appeal:


    This latest ban looks really like retaliation tbh for having that ban overturned, and feels very personal. Despite having my ban overturned I extended a “no hard feelings” message to the moderator - who refused to reciprocate - which I found very unusual tbh. I can supply the PMs on this if required?

    When I mentioned it to the moderator that this latest ban seemed retaliatory and personal in light of my successful appeal 2 weeks ago they claimed that they had no recollection of the ban. Given how rarely bans are overturned on the site it is really stretching credibility for a mod to suggest that they didn’t realise that the ban they handed me just 2 weeks ago had been overturned - especially as I was instructed by an admin to PM them after my appeal was upheld.

    The ban is for 1 day. It’s not about the length, it’s about the principle of this. I feel it’s excessive (when a warning would suffice), and personal and retaliatory for the reasons I have outlined.

    During my last appeal I was subjected to horrific abuse from a poster who re-ragged 6 times to abuse me and allege I’m s former poster (which I am not). fully aware I’m subjecting myself to the wrath of the troll and his abuse again by doing this - which I did point out to the moderator, but again, no acknowledgement was received on this point and no reduction.

    As I noted on the thread of my last appeal I believe that posters thanking abusive lists like those should receive a warning or a ban themselves and Mike did acknowledge this and said he would look into this. I hope that is noted when the inevitable happens on this one.

    For your appeal to continue please post the full PM exchange with the moderator in question. The Black Oil will look at it when he returns, so you will have to wait.

    A lot of your post above is irrelevant to your appeal. Please stick to just the appeal of the warning in this thread.

    I would have thought the whole point or PMs is that they are private and not for public dissemination?

    For the purposes of DRP you are allowed to post the PMs.

    If you don't want to post them or don't share them all with the C-Mod then the appeal will be closed.

    The CMod will also confirm with the Moderator that the full exchange been shared.

    May I ask who the C-Mod is then?

    I’ve asked for clarity on what you have said is irrelevant but I don’t receive a transparent answer. There are contradictions between your post and that of The Black Oil Helen confusion.

    Re. Point a) - that should be disfiguring grounds for an appeal on this issue as the ban was excessive when a deletion and a warning would have sufficed.

    The Black Oil is the CMod. He will deal with it. But you will have to share the full PM exchange with him in order to further the appeal. For now nothing else is relevant. If The Black Oil needs further information from you he will ask for it.

    I'm overturning the original decision on the basis that you were referencing what JD could discuss on the air in an elephant in the room type way with the national broadcaster. Had you gotten into the details of RTÉ's problems the warning would still stand because there's another thread for that. Had your original screen shot message generated back and forth with other posters then you and them probably would have been asked to pull it back also. Due to Vanilla, I don't think I can do anything about a ban record. The warning can be reversed. No need to pick things up further with the local mod.
