    If Irish Rail/CIE own the alignment, why did the council route around a location between Killeagh and Mogeely (see link)? And for the replies: Let's take care not to accuse anybody of anything illegal if you cannot back it up.

    Context Midleton Youghal section is being converted to a greenway

    Someone has grabbed a section of alignment at a level crossing

    The last movement on the line east of Midleton was in 1987, some track was lifted in the section in 1992

    12 years is the base adverse possession requirement, 33 years have past since CIE/Irish Rail can claim possession through use/occupancy so a adverse possession claim would likely stand. The standard is 30 years if the land is state owned, CIE is a semi state does that count, either way 33 years have past

    Totally possible, Railway Order includes CPO powers so it would be trivial to get around this but at the expense of preparing the RO
