"sub" (??) banner menu not locked

there appears to have been a change to the menu banners. at the top of the page the "sub" banner is there, but disappears immediatly when you scroll down. see in red above This is a PITA as theres no recpricol banner on the bottom of the page, therefore you have to scroll all the way back up. any reason this was introduced?
