Tortious interference ( A FRIEND OF A FRIEND)

Hi all

My question is whats happen to me is this Tortious interference can you fight this, can some one help us? please post this everywhere and every social media group.

I wanted to tell you a situation my and my wife have had happen to us and we are very stressed and down about the whole situation.

we decided to move back to Limerick the end of last year and i was working for 20 years plus in the entertainment industry and my wife worked in a great Job as a school teacher in London, I was searching for a property previous to this for 3 years and then I we found what we were looking for a lovely old house in a small village in Co limerick.

we made an offer and the seller sold it to us at a bargain. the property had a few issues it had 2 lease hold strips of land with it and a main section free hold all for sale in one lot, the landlord of the freehold section was the HSE and the seller still had 36 years left before it ran out, now the lease hold section is actually the front garden of the house so it would be vital going forward to purchase it from the HSE at some stage in the future to join the leasehold up with the freehold and make the entire plot complete.

so we questioned the seller on this if he had ever gone and tried to purchase the land from the HSE he said yes but the HSE put them on a holding letter situation not moving forward on the issue. now heres the sad thing the people of the house the sellers had for decades contributed to the medical center next door as the father was the doctor in the village for so long and would walk throw the gardens to get to the clinic next door to te property for years, you would think that after all this man had done for the clinic next door and the community before he died that the HSE would have made it easy for the property owner in the selling of the property as the lease hold land was making it difficult to sell the property as it, the land was useless to the HSE and very important to the Owner as it was the front garden,

Now the HSE tried to buy the free hold section of the land off the seller during the Celtic tiger and they were told no, its the land close to the clinic to expand it so this may be the reason the HSE refused to sell the freehold just out of spite we know that in government bodies there are character that have a personal vendetta against private property owners and use there power and law to destroy their lives using tax payers money anyway jump forward to now and to us and our situation with doctors family.

We go see the house and land with it and fall in love with it its a lovely place, but as we're heading home in the car to see the property my wife's friend turns to my wife and says "yeer buying a house with land that the HSE are landlord, I know the top boss in the HSE estates section she might sell the land to yee" my wife said don't ask her but her friend did in the end and she got back to us and said, the If we decide to dispose of the land in the future we would be asking for full market value for the front garden.

with that and surprised that my wifes best friends friend was high up in the department we decided to take the risk and put in an offer the third offer was accepted, because our offer was accepted we were so delighted that our dream was going to come throw, sold knowing that we sold our property paying for Auctioneers solicitors in London , transported our belonging to shipping containers in Limerick from London which was about £5,000, got a solicitor in Ireland to buy it for us and at Xmas,

we were in the middle of contract signing up to this xmas everything was very good hadn't signed anything yet and me and my wife said lets go look at the property at xmas so we were so happy to be living the dream, we got in the car and headed to the house I could wait to see it again, the reason why I loved it was its old charm and over grown gardens I was going to have a great time exploring "what a dream" we headed as we approached the big trees on the site looked beautiful, we drove up the drive and got out with big smiles on our faces……. and then I saw on the ground remember this is is the middle of winter a freshly cut leaf on the ground and then I said to my self what the hell is this way is someone cutting this time of the year, then i went down the side of the stables and I then found a freshly cut branch on a pile of old garden waist, not good then when i looked to my right someone had cut a hold throw the under growth and i went throw and followed the freshly cut path as I went it started to see branches 4 5 inches think lopped off of holly bushed and then when I got to the clinic side of the garden, devastation appeared in front of me all the trees hand been felled and not from the top down and large pine trees toppled. I was devastated 12 trees were felled even trees that were 40 foot away from the Clinic wall an old fruit tree that was in the garden for a long long time and it was completely gone who ever did it took the wood for its value and left the large pine trees.

I ran around very unset and very angry, I way way what the hell was going on, I was so angry I could phone the auctioneer, so went we got back my wife call hims, he was shocked and he said "I got a phone call from a man saying he was from the HSE and would it be ok to lop off branches over hanging the clinic and the auctioneer said I cant give that permission let me talk to the owner, the owner said yes to the auctioneer he passed it on to the HSE man.

We were very angry we knew that the HSE contractors had taken a break for the xmas because the tree were clear and chopped up just left felled everywhere we new they were coming back to do more damage after the xmas now these trees were 60 70 years old and you cant replace them they were part of the whole charm of the property and the very reason we put in an offer AS SEEN, but some one took a notion to change the property.

This incident made us not trust anyone that was selling us the property all we knew was the HSE got onto the land even though they only asked to lop branches off over hanging the wall.

we then requested that all works on the site stop so it did and we asked what the hell happened did the owner give them permission to go onto the land and fell whole tree???? from waht we only know from the auctioneer this wasnt the case, so we put that to the owner and he ignored the question and we never got an answer back.. time went on I managed to get over the incident and we kind of had moved on and continue with the purchase, no answer from the owner and I said to my wife I bet that that woman behind all is your friends friend I was very angry that a good friend of my wife was good friend with the person at the top of the HSE that could have put pressure on the owner to fell the tree and my not of had full consent to go onto the land and do that amount of damage. I was just guessing it could be her driving this damage… I asked my wife to call her friend to call her to stop it be cause I had my suspicions but my wife refused to drag a friend into this crazyness so i got no answer from anyone.

then after the damage was left on the land and a little time had passed one month around feburary , we taught ok the house is still salvageable, lets move on and we can do this i started planning the shipping of all our possessions it was so much work 150 boxes and lots of furniture we had pick ourselves up and got on with it we we're happy again and I said I would clean up the tree and make it a beautiful garden again for me and my wife. we were so happy again all water under the bridge, our flat was signed over a few days ago and 2 weeks from now the buyers of our flat in London were going to complete on our property, the shippers came and last monday 24th of Febrary and dropped all our stuff from London to container storage in Limerick. we 're nearly there we were only 2 weeks away from paying up full and the contracts were almost signed, on the house in Limerick all going good, we had stopped any more damage and we were happy to move on.

On the 25th of this week all of a sudden the sellers Solicitor forwards on to my solicitor, "stating we would like to resolve the issue with the tree before moving forward with the sale so we've contacted tree surgeons to get a quote to fell more trees and attached to the email was a threatening letter from a solicitors firm in Dublin representing the HSE saying we are putting you on notice we want to cut more trees down on the property, they lied on this letter to get onto the property by saying that the trees were a danger and branches had falled during the storm and the tree they didnt get a chance to fell because we told them to get of the site was in danager of falling onto the clinic and the only damage that was there was all the felled trees that the HSE damaged they left branches strew every where and I was left with a mess that they made to clean up so they were using this damage and saying it was storm damage that had happed, its funny the photo the sent to the owner as proof showed chainsaw cuts on all of them not breaks trying to prove this was storm damage, they basically were fabrication Nonsense to scare the owner into a making a rash desision to let them on again. and so in his email to us he was doing so.

Im not joking you I felt like fainting with the stress my heart sunk so low I started trying to figure out how could I at least stop the owner and the HSE destroying our dream and at least get between them and talk to the HSE in amicable, please meet me and I can supervise the pruning and cut so that they would run amuck like the last time and destroy more beautiful tree.

From the threatening letter HSE sent to the owner I saw the email address of the Sellers solicitor the HSE solicitor threatening them and the phone number of the Clinic maintenance manager next door, I know what I did was not the normal approach but the HSEs pressure on the owners and the owners lack of concern for the properties condition when he handed it to us was to be honest very shocking. so I wrote a letter to all of them telling them the damage the HSE had done the first time and that it was all the storm damage was complete fabrication and the damage done was everything they had done at xmas,

I was there before and after the storm and everything was identical to what the HSE had left behind for us to clean up, the day of the discovery of the damage at xmas I videoed and photographed all the damage and because I think I'm weirdly observant of nature and anything out of place, what the HSE was saying was pure fabrication to scare the Landlord to finish the job,

I then phoned the maintenance man in the clinic a number I got from the solicitors letter, to try and get a message to the HSE to tell them please stop we're very near completing the sale I'm the buyer I will meet you and the Clinic manager on the property to go throw what needs to be pruned and cut to satisfy both partys because I was going to be the new owner soon, the maintain was really lovely, I said whats all this thats happened whats going on? he's "said we ask for permission to chop branches off over hanging the clinic an those boy came from Limerick city from the HSE and Felled trees on the property and he said they were even going to go onto the property with heavy duty machinery and do huge damage, he's was to my impression a little taken back by it all.

I waited to hear back from the man, he spoke to the head person behind it all and got back to me, and the maintenance man said she didn't want to talk to me only the owner, now i told him that I wanted to talk.

A day later the HSE sent me throw my solicitor a seas assist letter to tell me stop contacting them……I was trying to save what was left of the trees in a considerate way so that the HSE and me being the owner next might both be happen going forward they weren't interested in talking to me the next new owner.

when the Maintainence man got back to me I also asked "who's this woman behind this carry on thats putting pressure on the owner coming between damaging the sale of the property to us and as ever body knows the conveyance an sale of a property is a very delicate thing and interference by a third party especially some one who has no intention of buying just interfering can be the death nail and destroy all the work done. it turned out it was the very woman that my wifes Best friend was good friends with in the HSE at the top

The next day the owner pulled out of the sale, me and my wife were shocked distraught and left with no were to go and me and my wife for the passed few days have been fighting with each other me accusing her of not taking my hunch seriously and to contact her friend to tell her power hungry fiend to stop bulling the owner and at least let us buy the place so we can then talk to the HSE. but now I'm the patsy here being blamed for everthing because I contacted the HSE to try and make thing good between me and them.

The HSE new the property was in mid sale and stomped all over us and the owner and damaged the property and the delicate transaction and caused friction and the sale fell throw we were 2 weeks away from putting the keys in the door and being very happy.

I'm just so unset by all of this my life has been turned up side down, Im in shock, at the being the owner never told us of the damage being done but Id say we were the ones that alerted him to it he didnt even know because the house is vacant and he never visits, I'm shock we never got a answer if they had been given permission to do all the damage, I'm shock at the attitude of all the Solicitors involved, no regard for a massive commitment to the property me and my wife had made giving up our lives in London selling our flat 10s of thousands down in solicitors and mover fees, no place to go for us and most of all the person behind it all was a friend of a friend in the HSE. is there any justice in the world at all for good people I have lost all hope the my people are decent I have only seen very seeky back stabbing behavior even from Friends of a friend and to think that night my wife call the friend of hers in the HSE it probably alert them to the sale of the property and thats when they punched she decided this is the opportunity to interfer and get what they wanted even though she knew that her friends friend was buying it.

people like this are evil and heartless and are hungry to impress upon there work college that their tough and they can get the job done and their paid by you and me tax payers money shocking they'll even crap on their own door step to get ahead, even to crap on friends of a friend.

I have no course only to find home for me and my wife, it took me 3 year to find that one and believe it or not the house was on the market for close to 2 year and we were the only one that ever made an offer and they dumped us, I dont get it. I jus dont get it.

Did anyone lose anything in this not the HSE, not the owner they never cared about the property, only me and my wife cared.

and to make matter worse my dad died of prostate cancer 2 years ago it was caught early and the HSE in the university hospital neglected him and skipped his whole treatment for a year and when we tried the get his records to find out what happened they refused to give them to us for assessment, theres some very nasty people working in the HSE from the top to the bottom its festering like an open sore and no body will gut it and stop all the mal practice going on its in every department and now I've lost my father and now a house we wanted because of them. Ireland is a great place but full of Rogues Parasites and dangers individuals they use their positions to destroy and cover for each other and we are all paying them massive wages to ruin our lives, when is it going to stop.
