Amazon Small Claims

    Does anyone know if you can take Amazon to small claims court?
    My cousin got an airfryer and it arrived damaged. It was expensive one.

    Yes in my experience don’t know full details

    She was on hold to CCPC for ages

    I thought I’d ask here cause you’re all full of knowledge

    There must be more to the story because Amazon have a 30 day+ free return policy and even after that with faulty goods their customer service is usually great.

    Don't expect anything from life, just be grateful to be alive.

    She wants this one (kitchen colour) and got it for a good price, it’s out of stock now. So was looking at a repair.

    it’s not CCPC it’s ECC1 or something.

    OP, when did she buy it? What is wrong with it? Has she been on to Amazon customer service about the issue? You are telling us nothing.

    The small claims court won't magic up an appliance if it's out of stock.

    Have Amazon refused to refund? It sounds like even if it wasn't damaged she'd have a 30 day window to return, never mind if it is damaged.

    As others have asked - has she actually been on to Amazon about it?

    Jesus the Spanish Inquisition have nothing on ye.

    She WhatsApp’d me airfryer from Amazon arrived damaged. They can’t replace it, they’ll refund. I want it repaired. Do I have a right to ask for a repair. Can I go to small claims if they have accept my repair request.

    Me: I know who’ll know the answer this.

    Try answering the question that’s asked.

    Can Irish customers use the small claims court for Amazon Uk purchases?

    while you wanted to know what she had for breakfast I found out no they can’t but can raise a complaint through ECC

    OK, well now we have some actual information to work with!

    I don't think the small claims court have the power to order a repair. AFAIK Amazon have the choice of repair/replace/refund - replace clearly isn't an option, but I think it's their perogative to just refund.

    Has she looked into just getting it repaired herself if she's that keen on that exact machine?

    She does not get to choose repair, Amazon offer either repair, replace or refund.

    They have offered a refund, that's it, no small claims court needed.

    You have 6 years to use your right to the remedies outlined above.

    How that works in reality with the likes of Amazon (assuming it's the UK one) I don't know…… but for sure I don't think the SCC is the avenue to go down

    Thanks I think there was confusion about the Consumer Rights Act 2022 which she said you can request a repair. But that’s Ireland only.

    Anyway I found it on another uk retailer so she’ll take Amazon refund and collect other from Newry.

    With Amazon you are dealing with Amazon SARL in Luxembourg and you are paying Irish vat. That it actually comes from a UK warehouse makes zero difference.

    Both here, in Europe and also in the UK, you can request a repair. (or replacement or refund) But the retailer can refuse any specific request and make their own offer of one of those 3. Only if its unreasonable, can you refuse it. A full refund would not be considered unreasonable

    btw - its usually the other way around with retailers wanting to repair an item and the consumer wanting a refund

    I have no idea what fuels women but it’s not gold plated it’s some shade of green. She’s not far from the border so Newry is near enough and a day out.

    Thanks for the info though, had no idea how it worked.
