Boundary Verification

    Semi Detached house purchased August 24, where the 2 houses are joined is not the boundary, his back garden comes into and sits approx 1 metre along our back wall which is fenced off. There is no dispute at the moment but neighbours have now said that the land he has edged into was once belonging to our property. I have gone down the route of the land registry and all other planning sections of

    the council but cannot find anything that shows when it changed, I have transfer map in 1992, then a new one in 2023 bit can find nothing in between to show how the differences came about. No one seems to be able to help any ideas ????

    Yes definitely, and been though Land direct , ROD, CSU Dublin and am at a loss no one has any information on the changes between 1992 transfer map and the 2023 land registry map. I am at a loss as to where to go now

    We spotted the discrepancy at the time of purchasing the property, we asked our solicitor to verify the changes and after several attempts with no response we were told to get the deal signed by xxx or the house goes back on the market deal lost…we desperately wanted the house our 9th attempt at a purchase and near my family so we though we would keep up the search once purchase .. silly fools our solicitor was not great to say the least

    Its a strange one but not entirely unique. From what you have described it appears there was an alteration made to the boundary between 1992 and 2023. It could have been agreed between your neighbour and the previous owner of your house or it could have been a mistake made by Land registry. Around 2010/11 they (LR) made the jump to digital mapping and in doing so they also made lots of mistakes. In any event there should be a paper / map trail and there is a process that can be utilised to query these matters so talk to a solicitor and get them to follow up and get the details from LR and request a correction if they have been at fault.

    Is it possible that the land behind both your houses was originally a laneway and your neighbour took in the laneway but also took in yours? This has happened in 2 houses I've owned.

    I do think you're in a weakened position here. Any idea if the neighbour has claimed adverse possession?

    He only moved into the area in 2019. So Adverse possession is 12 years?

    Anyone know of a good solicitor dealing with land boundary issues .. checking online bit of a minefield thanks
