Notifying Land registry of deed of discharge during probate

    Hello I am looking for some guidance before consider to engage a solicitor. I am the executor of a will. I completed Probate myself and probate has been granted. The Estate just compromised of a small cottage, and all outstanding bills and loans are paid. The Bank have provided me with a letter and Form 57A/ Deed of Release - "authorisation and indemnity for release of title deeds". I.e release interest in the property to notify land registry.

    Prior to selling the property and distribution to beneficiaries I intend to lodge the application to land registry myself in to remove the banks interest from the folio as I assume not doing this would slow down the selling process. It's looks fairly straight forward but want to ensure I don't fill out form correctly.

    1. Is there any guidance on completing the Form 17? If it's easy to mess up I was considering engage a solicitor to assist with this along with conveyance services

    You have to engage a solicitor to deal with the conveyance, obviously, and the solicitor will deal with this as part of the conveyance. It's not likely to lead to an increase in the professional fee he would charge for the conveyance — conveyancing fees cover this kind of thing.

    Your solicitor can lodge the 57A along with a transfer application with Tailte Eireann. It can all be done in the one application.
