Can the council put stuff on my land?

    Hi everyone,

    I bought a new build a couple of years ago. In the buying contract I have a drawing where is specifically states that the flower beds around my house are of my "exclusive use" as the owner of this property.

    Can the council just put up signs and stuff on that land without my consent?

    Here is an example of what I have on my contract:

    Blue area: Site boundary

    Red area: Denotes area which dwelling owner has exclusive use of

    Are u sure it's the council and not the management company?usually the MC would own and maintain common areas in new estates.

    BTw,the area in red is for your use but you wouldn't own it.

    I'm not sure actually. In either case, if I hold exclusive use of this area, shouldn't both MC and Council require my consent to put things on it?

    Dont think so,if the MC are the owners they can do what they want, you only have the use of the red area.

    Check on land direct for what is ACTUALLY registered to you. If something is not within your folio you dont own it.

    How do I do that in land direct? When I click on a the map I see a red block over our estate.

    You need to talk to a solicitor.

    This forum is for asking advice on stuff in general. Nobody here is gonna be able to answer your question comprehensively without access to a lot more information, information which posters (rightly) are reluctant to give out willy nilly. Nobody can say yes or no without looking at your deeds and documents, knowing whether or not your property is leasehold/freehold, whether it has an MC, what the MC looks after etc.

    You haven't even given an indication of what's on the sign……..that would be a good start to figure out who put it there. How are people supposed to help you how to play your hand if you're not showing them the cards?

    Bottom line: if it's bothering you that bad, speak to a solicitor. If it's not bothering you that badly, just forget about it.

    Noop, not if it's not your land. The owner of the land doesn't need permission to put things on your land.

    If you own it, different story, but doesn't sound like you do from the OP.

    It's really not a issue that a solicitor is required to decipher. It's outline in pretty straight forward terms on the deeds.

    Leasehold or freehold wouldn't make a difference. Neither does there being a MC. If the OP doesn't the land, then either a MC, the council, or some other 3rd party do, doesn't matter who.
