Incapacitated Child Tax Credit

    Hi, i recently submitted both forms for Incapacitated Tax Credit but was refused as i dont have custody of my partners son. He is 25 years old and has his disability since birth and will never be able to look after himself for the rest of his life. I have been living with him for 18 years now and class him as my son. I provide him with all his financial needs as his mother does not work (carer). I didnt think i was entitled to this credit but recently i was encouraged to apply by various sources but as mentioned i was refused. The reason i was refused is because i ticked "no" when asked if i have full custody of him. I have thought about it more and i guess I do have custody of him but not by law, i mean how an i supposed to get custody of an adult, i cant adopt him as he is not a child. Myself and his mother have been cohabitating for 18 years. I have resubmitted the forms but ticked "yes" for the custody question this time. Is this a fruitless claim or am i entitled to be optimistic this time around or am i even entitled to the credit. I would love to know what anybody thinks about this or has anybody had any similar situations. Thank you :)
