Census Pilot 2024 Mandatory

    Hi All,

    Is it mandatory to comply with the Pilot Census 2024. I see no reference to this matter on the CSO site.

    I don't believe it is mandatory.

    Under Statistics Act 1993 s. 24, the CSO can invite any person or business to provide information on a voluntary basis. Obviously, it's not mandatory to provide that information.

    Under s. 25, the Taoiseach can make an order requiring persons or businesses to provide specified information to the CSO. Each order has to relate to a specific survey that the CSO is conducting.

    So, the default position is that responding to a particular survey is not mandatory. It only become mandatory if the Taoiseach makes an order saying, in effect, "this particular survey is mandatory".

    I don't believe any s. 25 order has been made in relation to the Census Pilot Survey. And the language used on the CSO website strongly suggests that participation in voluntary ("Everyone can have the chance to take part"; "We are asking people in all parts of the country to participate").

    My understanding is that most of the surveys undertaken by the CSO are voluntary; only a minority are made compulsory. And, where a particular survey is compulsory, the compulsory nature of the survey will be highlighted on the first page of whatever documentation people receive in connection with the survey — it would be unfair to penalise someone for not complying with a mandatory requirement to provide information if you hadn't pointed out to him that it was mandatory in the first place.
